Frustrated! October we filed AOS for my wife, who came here on a k-1 and we are now married. When I field the k-1, it is a different affidavit of support form, my disability was allowed as income to get her here. Now married and filing Change of Status and for EAD, they use the I 864 affidavit of support form which is different. Anyway, got a RFE yesterday account "my income was below the 125% poverty level!! Fine and dandy now she is here and we are married! The I 864 form does not have a way to show my disability income without making a supplemental to it and adding a note to the process. So, it was RFE'd back to me. This seems really silly to me, and frustrating. Anyway, on the RFE it says either add assests or get a co sponsor. I would like to write them back and tell them to look it over again, with a copy of all I sent, but, I find just using a co sponsor will be much easier then trying to explain to them, (because you really never get to talk to anyone anyway!) So, will feel more secure to just use a co sponsor. I am writing this for anyone else that is disabled and searches for an answer. Hope this will help you. I know I searched high and low for help. When calling USCIS, they told me to consult an attorney. Well, if they figure my income is under poverty levels, how do they figure I can afford an attorney!

You list the income under part 6 #5, your current annual income. You need to provide solid proof of receiving the disability. Letter from SSA, 1099, bank statements showing actual deposit amounts, and things of that nature. The CO either did not see the proof that your income does indeed meet the 125% requirement for your household size, or they are still wanting to see a joint sponsor or assets anyway before making a final decision on your case.

What is your current annual income amount, what is your total household size, how did you fill out the I-864 and what evidence did you send with it?
