My wife was deported from China back in January 2013 for an L-Visa overstay. We are starting the i130 process and was wondering if this going to hurt her chances during our application process?

China can not provide Police Certificates for those on L-Visas...and she was there longer than 1 year. What can I prepare? Anyone have this happen before?

5/3/2013-Our son was born!

9/26/2013-Married in Manila

1/31/2013-Filed i-130 DCF Manila for Wife and Step-Daughter

2/5/2013-i130 Approved

2/7-2013-Wife attended CFO, Manila

2/8-Wife and Step Daughter apply for new passports with my surname

2/18-Received case numbers from Embassy

2/24-Completed DS260 for Wife and Step-Daughter

3/5-Day 1 of Medical Exam at SLEC...

3/7-Day 2 of Medical Exam at SLEC...PASSED!

3/7-Rescheduled interview for March 24, 2014

3/24-Interview PASSED!

3/27-Received passports via 2GO Travel

Illegal visa use in another country will not affect the I-130 process.

You may want to ask your question about Chinese police certs in the China forum for more expert opinions.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ok well that's sort of a relief, haha...

I'm just curious what documentation we could provide from China because it was an L visa, so they won't issue PCC...I'll ask over in the China forum...see what I can dig up...thanks.

OK...I spoke to the embassy and they said a letter from the Embassy in China or the Police Department in the city she lived stating that PCC's are not issued to tourist visa holders would satisfy the condition. They even said they'd accept an email from either...so there's a resolution for those in a similar situation...(although I can't imagine this comes up often...)
