PLS, do not jump down my throat, I'm just curious and would like some answers, I do not need to hear what right and wrong, I do already know that.

As a part of a country that goes under the visa wavier program, me, my husband and our two children are planning a trip to the US this february, my I-130 is still pending since august, but with documents proving that all of us are planning to return with a closed ticket two months after arrival, as my husband has proof that he is going back to work, I'm on maternity leave and we have a house, bills and ect to proove our life in sweden.

our kids are dualcitizens and Im waiting for my I-130 to be approved.

However, if we for any reason while in the states decide to stay, is it then possible, as I entered to country leagally, without the attempt to overstay, could I then apply for adjustment of status and legally stay there and wait for my visa there instead of going back to sweden alone with our two infant children?

please, I do not need to hear what wrong or right, I just want information.. would it even be possible? Im very unfamiliar with the process of an adjustment of status.

to answer your question, of course it's POSSIBLE.. but the issue will be the possible lifetime ban you face when you go for AOS interview and the interviewing officer's job is to find if in any way it seems like you could have intended to do what you're saying you're possibly intending to do.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
