RFE I751, unique condition. please help

Recommended Posts

You need to call them to follow up on the matter, the interview letter might be lost on its way. Otherwise you will be shocked when they send letter of intention to remove or deport due to failure to show up at the interview.

Would it be wise to get the Senators get involved in this matter or should I simply wait for them to send me an interview date? What makes it hard is that the case is transferred to the field office and when I call the national hotline, they do not have any further information.

Did you talk to a tier 2 rep when you called the hotline? The tier 1 reps are pretty useless.

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

 

Passport

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number

We are having the same issue..... We filed in April 2013 to Vermont. Received the same RFE in August 2013 and sent back ALL info requested even though they already had it from the original GC filing. Ours was transferred to the Atlanta Field Office - but we were never informed of that until we did a service request in December 2013. We were told that we would just have to wait until an interview could be scheduled. In March 2014, after hearing NOTHING -- we contacted our Senator and had them do an inquiry. That was a waste of time..... they got the same response that we did -- wait..... We filed another service request in May -- same response. My husband's 1 year extension on his GC ends today, June 16 -- and of course his driver's license expires today as well. On June 11, we once again called and were told that Atlanta is extremely back-logged and that our only option at this point to "speed things up" is to make an Infopass appointment online. We tried numerous times with nothing available -- but being persistent -- finally got one for June 26. When we check our online status, it STILL shows "Initial Review" -- and we STILL have not received anything directly from the Atlanta Field Office. Really ready to get this part of the journey over with and trying to stay positive -- but let's be for real..... the US Govt. hurries for no one..... GRRRR!!!!

If you are still married and you are permanent resident from last 3 years then file for citizenship...by that way it will speed up your ROC .

As I understand, one can FILE for citizenship but before the citizenship interview, the GC process should be over and one needs to have a permanent GC to go ahead with the naturalization process.

Just an update

I contacted my Senator and authorized him to contact USCIS on my behalf to see what is going on.

I also went and got I-551 stamp on my passport that extended my legal status for one more year while the case is pending.

I also inquired with USCIS and they said in a letter that "the case is currently in suspense until an interview date has been scheduled."

Nothing much further I can do besides waiting!

As Panga already said, filing for citizenship will speed up your ROC process

I understand that but for now I do not want to file for citizenship as my native country does not allow for dual citizenship.

Nothing but crickets so far.....waiting patiently as I don't have any choice.

Why don't you apply for citizenship? It will definitely speed up the i751 process. I know a friend who was in the same boat as you and he applied N400. With in a month his ROC was approved.

05/16/2018: Received Date/ Priority Date - NOA Received

05/25/2018: Received NOA Bio-metrics for I485 Appt: 06/10/2018

06/10/2018: Bio-metrics are completed

06/12/2018: Received RFE requesting for a Birth Certificate for both parents

07/28/2018: Responded to RFE, sent their non availability of birth certificate copy

08/02/2018: Online status changed to " Request for Evidence was Received"

08/29/2018: Made an info pass appointment requesting for expediting Travel document as parents had to travel India. Expedite request was rejected 

09/14/2018: I131 Parole document was Approved

So, my I551 stamp expired in August so I went to get another stamp after making Infopass appointment. I got another stamp on my passport for one more year and the officer said that they are very back logged with a lot of cases here in Dallas so they will start calling people for interviews soon.

After about 2 weeks of my stamping, I got a letter to appear for my biometrics since the one I had provided had expired as it had been more than 2 years. So I went in and did my biometrics and WAITINGGGGG FOR INTERVIEW!!!
