Hi! I'm a green card holder and I have a two-year old son in the Philippines who I want to get a B2 visa so he can visit me here in the US. I am not married to his father. He has abandoned us before I went here in the US. His name is in his birth certificate though. I am now married to a US citizen and once my husband and I get situated, my husband is going to petition my son. My parents are taking care of my son at the moment. My parents are planning to visit. They want to bring my son too but he doesn't have a visa yet. Will there be any problem with the immigration/US Embassy if my mom applies for B2 visa for my son? What is the likelihood of him getting a visitor visa? What are the requirements? Thanks!

One major problem...why would this infant return to the PI???? Why wouldn't he (or you choose for him) to stay with you?

In other words, what could you realistically say to the CO as to why this infant would not remain in the US during the period of time you referred to as 'getting situated'?....this baby does not have a job, nor school to act as a tie...only his mother, who is living in the US....

Sounds like your Parents have Visitor Visa's?

How did you enter the US?

The only way you will find out is to apply.

The child having a green card holder mother and US citizen stepfather will unlikely be issued a tourist visa since the immigrant intent is strong.
