To be fair, I am going to assume many people in this position would have taken a vacation in the US and then decided to stay and adjust status.

I've noticed people have been so uptight recently on this forum. It's really disheartening. Makes me want to close my account.

I asked the senator's help for expedite process for my mom, I have an autistic child and having in home ABA therapy. I left my job to be with her during therapy and more medical expenses for my daughter, husband and father who has tuberculosis in the Philippines

My petition was submitted last May 20th and never been touched since then. It's almost 6 months now.

The senator's office submitted the documents last Oct 28th and submitted additional document last Nov 13th. The senator's immigration liason told me that they still reviewing my expedite request.

Take note, my petition is almost 6 months now since NOA1

I'm sorry for your hardship and all your going through.. Now let's look at it..

I think and someone can correct me but in 2011 USCIS removed medical as part of the expedite criteria

Not to say that you will or will not get approved but hopefully your senator realized this and focused it more to financial hardship. But it all depends on who reviews it and their mood for the day.

Your at 3 weeks and typically they have a answer but not updated in the system yet. Depending on who your senator is contacting depends on the answer. I would suggest you contact your senator and ask for a status for the "expedite only"

Thanks for information, I appreciate it. The senator staff told me last Nov 13th that she will contact me as soon as she hears back. As of now, I didnt hear from her.

Yes, She probably put financial hardship. Because I clearly stated in my email to her that loss of job but more medical expenses. My husband has 3 jobs so he is earning good money but loosing my job and more medical expenses (for my daughter, husband who has medical procedure for 3 months and my dad who is recently diagnose that has tuberculosis so I have to help financially) make a difference since our expenses are already set. So I do not know if it's qualified for extreme financial hardship.

So as others we waited for our turn, but then decided to submit expedite request because it was over 5 months and not even touched.

Staying on topic..

I do not want you to get your hope up and stay level minded...

For a petition filed in the US.. After the I-130 is approved it does not go to the embassy.. It goes to the NVC.. Your filing for expedite at NBC which is only for the I-130.. The NVC will require another expedite request to be approved.. Then if that is approved all goes to the embassy..

For petitions filed abroad? Maybe someone has experience in this that can explain the process they went through..

I know if expedite request to NBC is just for NBC not NVC which is the stage she is at.

I read expedite request to NVC goes to embassy for them to approve and if approved everything goes to the NVC (skips NVC process)

But that requires 2 different expedite requests.. 1 before I-130 approval at NBC and 1 after I-130 approval to NVC..

But is the process different for petitioners filing from abroad?

I don't think it's true. If you send an expedite request to NVC, it is actually approved by the consulate and then NVC stage is skipped, and you bring all the documents to the embassy for interview.

If USCIS expedite case it goes to NVC and again need to ask for expedite. If NVC Expedite - sends you a email that your file goes to embassy and there will need to collect documents and pay the fee.

Our letter from NVC:

Dear Sir/Madam:

The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition: VIL20138**** filed by ******* on behalf of ********.

Your request for the expeditious processing of this immigrant visa petition is currently under review. You will be informed of the results when the review is completed.

To complete your request for expeditious processing, we need two foreign phone numbers for the applicant.

Please email the numbers to NVCExpedite@state.gov. We will update the case once we receive your email.

I just want to share our experience. We got our NOA 1 last May 15 and my husband filed to expedite the process last Nov. 16. He sent a letter to the Senator and we finally got NOA 2 last Dec. 12. We waited 7 months for NOA 2.

We filed for an expedite under two different criteria at the beginning of the month and got a denial email in less than two hours. During this time I was also in contact with my senator and although her office was very professional and nice, they basically told us that to get an expedite I would need to be close to death or beaten by towns people and have everything documented by the police and hospital. It was very disheartening because our situation is indeed terribly serious. Joyfully we depend on The Lord for our strength and comfort, not the government. heart.gif

Being granted an expedite is usually rare. Congratulations! We do not want anyone to suffer, and we're so happy you get to go "home"! Good luck with your new baby and making your new life! goofy.gifbiggrin.png

*On 08/01/14 I received a checklist via email and responded right away. Over a month later, on 09/09/14, I received the hard-copy in the mail. Upon reading the hard-copy, I found that NVC made a mistake and emailed me the wrong checklist. I contacted a supervisor at NVC and she instructed me to write a letter of explanation to accompany my "real" checklist response. She also told me this may not help me and that we may be back in line. Lord help us!
