I filed a request 2 weeks ago, via telephone and an additional via fax, just to be sure they got it. I know they recieved it cause they did an address update on our file.. But we haven't heard one thing yet... If they don't consider the request and denies it, will they let you know? I've also contacted the ombudsman and a senator, whom both have told us they are going to contact the uscis and assist us in our desperate request to get this case expedited.. I hate not hearing anything..

Does your expedite meet the following criteria? If not make sure it matches something in this link or your boat will sink. I just got approved for an expedite 3 days ago, but my case is in the NVC phase, but still same criteria must be met before a request is considered. I literally sent a request on Wednesday and got a response of approved 2 days later. If your case is strong enough they will give you the expedite requested, Once again you must meet the criteria,good luck!

It is financial loss, extreme financial loss.. I just think we should have heard something by now. It's a catch 52, our son is due in December, and we are living in Sweden and in Sweden one of The parents has to stay at home with the child for the first 12 months and we already have a one year old since before, so I can't work to support us and my husbands visa here expires in February and can't support us staying here and he can't afford to pay for two lifestyle on his American salary.. So me and the kids risks getting homeless if we don't expedited and can move with him.. Due to the crises in Syria the backlog at Swedish immigration is so long that staying here is not an option for him..

Personal Experience:

1. At the time you submitted your expedite then they should have asked you for a email.

2. They process the expedite request in 3 days.

3. About the 3rd or 4th day mark they will send you a email asking for you to submit documents if/or needed.

4. In 7 days from when you submitted you will recieve a generic snail mail letter saying they recieved your expedite.

Now this is where is gets quiet and your no longer provided any more information. They will not send you a email or letter saying approved or denied. You can call and talk to a tier 1 (does not have access to it) or a tier 2 (does not have the most up to date information). The best way to find out on your status of the expedite is to get your congressman or senator to do a status check on your expedite (which gives you the most up to date information). That should only take about 3 or 4 days depending on the workload at the congressman/senators office. If your approved on your expedite request then overall adjustment on your I-130 estimated time should be 25-60 days from the time all documents are submitted (even though they tell you 30 days) but they do not process them in order recieved. This is just my personal experience and I'm sure other peoples have been different.

So sorry to hear of your situation. You need to call the USCIS 1-800-375-5283 also( not just write them)-if you already have not.. and speak to a supervisor. You need to tell them you are due in December with a new baby. This may push the case up or even give into the expediting which you are requesting. Do not give up there is hope, there is always something you can do Throw every curve ball you can to win this and overcome. Best of luck to you and yours, I will be following to see what happens.

So basically, after documents have been submitted it can take up to 2 months for approval if they accept the request?

Yep! Also the expedite doesn't carry over to the NVC and another expedite request will have to be submitted and approved at the embassy after you get your case #. Which is 2-3 weeks after you get the NOA2 just to get a case #.. But this is just what I read on this (not from personal experience).

THEY DO send a denial letter..

And pregnancy is not a reason to expedite. You should have heard something by now

I thought Sweden had a pretty good benefits system, long maternity pay etc?

Im confused? is there some kind of law that forbids one parent from working after the birth of a child? That makes ZERO sense to me. What if its a single parent?

And even if they get approved tomorrow, The NVC takes approx 60 days, and the expedite doesn't carry over. They would have to request another one. And then the interview after NVC.. Depending on how fast Sweden schedules.. It could be a while.

Doesn't the petitioner have to be set up in the US anyway? So that could be a road block too since he lives there with her.

12 months yes and the benefit system is based on your salary and iv been staying at home with my firstborn, single parents can get help but in not a single mother and am married and have joined custody, so that's the catch. Nothing that says that both can't live abroad, a few years back those cases got expedited automatically.

Not to say anything bad but you filed in August? and have heard nothing? We filed in March and up until 2 weeks ago...we hadnt even got NOA2 yet...I got the congressman involved and he requested an expedite for us...my husand is in the occupied west bank....now it is approved but this was 8 months waiting...everyone knows this process takes so much time and we all wait. Again, Im not trying to be rude, but there are people on VJ that have waited much longer than 3 months for approval.
