hello,

We have been approved for NOA2. I wanted to take step to prepare for the i134. I am currently a master degree student, I will graduate in May 2014. I worked at school during this year but it is not that much. Maybe around $5000 at the end of this year. But last year I collected $12,000 unemployment benefits (does that count as income too?). I have three years past income that is over the poverty guideline as well. Also, after I get out of my master degree, I can go to phd school. Which will pay me $18,000 per year for 4 years. But I wont have that letter of approval and information until Jan or Feb. So do they take future income into consideration? And the perspective that I am going for PHD degree, and afterwards it wont be hard for me to find good work at the university I am attending.

When do you have to submit the 1-134? Please help! thank you!

The I-134 form is submitted at the Embassy stage, but you still have to get there first, and it seems the NVC step is taking longer than it used to. No harm in being prepared in advance, but just to give you an idea that you do have a little bit of time before it's needed.

That said, they don't factor in future income as it's not a reality yet, What matters most is current income. If you do not meet the poverty guidelines now, then I would strongly suggest that you consider finding a co-sponsor.

I would almost bet you are going to have to use a co-sponsor. If it is just you and your Fiance going to be living together alone, then you have to earn at least $19,387 a year. I'm not sure if they will look at what you will be making in the future. You can also use any assets you have to help offset the shortage you have

[March 2012 - June 2012] made travel plans, bought plane ticket, planned Vietnamese tea ceremony, bought engagement ring / wedding rings
[July 16th 2012] Met each other for the first time in person in Vietnam
[July 29th 2012] Had non-legal Vietnamese Tea Ceremony in her hometown
[August 16th, 2012] Left Vietnam to come back to the US
[August 20th - September 2nd] Prepared 1-129F packet to send to USCIS
 
K1 Journey
[september 4th 2012] I-129F packet sent
[september 9th, 2012] received text message from USCIS, stating that I-129F was accepted on Sept 7th
[september 11th,2012] received hard copy of the NOA1 in the mail
[April 17th, 2013] received text message on cell phone of NOA2
[April 22nd, 2013] received hard copy of the NOA2 paper in the mail
[April 24th, 2013] NVC sent packet to Ho Chi Minh City - US Embassy
[May 13th, 2013] Fiance received packet 3 from US Embassy in the mail
[May 20th, 2013] Fiance mailed completed packet 3 back to US Embassy
[July 9th, 2013] Fiance received packet 4 from US Embassy in the mail
[August 16th, 2013] Interview date, Approved!!!!
 
[sept 11th, 2013] My Fiance left Vietnam
[sept 12th, 2013] My Fiance arrived in Chicago and I was anxiously waiting at the gate for her.
[sept 25th, 2013] We got married
 
AOS journey starts
[Nov 14th, 2013] sent the AOS packet [i-485, I-765, I-131]
[Nov 16th, 2013] package was delivered
[Nov 22nd, 2013] received NOA1 via text message
[Nov 25th, 2013] check cleared my bank
[Nov 28th, 2013] received hard copy of NOA1 in the mail
[Dec 5th, 2013] received Biometrics appointment letter
[Dec 18th, 2013] Biometrics appointment
[Jan 17th, 2014] EAD/AP - card in the mail
[March 3rd, 2014] received I-797 in the mail, stating that my wife's AOS was approved, and to expect her green card in 3 weeks
[March 7th, 2014] received green card in the mail - we did not have an AOS interview

HI I forgot to mention that I have 60,000 dollars in saving in the bank. Is this enough to offset the shortage? I did find a cosponsor but he backed out. I wanted to do this on my own if possible. I will consider my parent but that is very slim that they will agree to it. Because I am in a same sex relationship that they dont approve of.

You have to look at your current income, look at the poverty guideline, calculate the difference and multiply it by 5. If it's lower than $60,000, then you're good to go, and you can definitely use that as an asset to strengthen your I-134.

If it's higher, then either you get more, or find a new co-sponsor.

Everyone told you the key things to calculate your poverty guiidelines. I just want to mention that Embassy in Vietnam does not accept co-sponsor . They said the officer will make the decision as to whether a joint sponsor will be accepted at the interview but most likely they dont accept .

Also, I dont think they will consider your future income. Most majors will offer more than 20,000 per year and it is usually 24-25K per year ( depend on school too it could get to 30K per year). Note that the acceptance letter for Ph.D says that the stipend will be paid from August, 2014 ( I assume you applied for Fall 2014, Ph.D) . Also, most of school will send out the acceptance letter around April, 2014 before the deadline April 15, 2014. Some students will get accepted around March 2014, where spring break is taken place so that students can visit schools. I know every school has different rules and for different cases. I just want to let you know that the acceptance letter might not come early as you wanted.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

I am dealing with this as well and there do not seem to be any firm answers of what the embassies will actually require.

The way most people are calculating it is being at 125% of the poverty level. With your assets you are not too far off.

The way I calculated it with your sixty grand in the bank you would need a job that paid 7,387 a year. That isn't too hard to come up with i suspect.

If not you could try to get your bank assets up by perhaps doing cash advances on your credit card, selling your can or perhaps even borrowing the money for a bit.

The easiest thing I can see is just take a weekend job for a while and that would set you over the top. That and with the 5,000 you already made this year should do it.

You will need to up your income or savings or prepare for getting a no answer. If you can't get the financial side together now I would stop the process instead of spending all of the money for the interview.

I am presently in the same boat as you and am scrambling.
