I need some information .I got k1 visa and gone to my fiancee where we have some personal problems and I came back with out marry .but i got social security card and my id and joint bank account too.i came back before my visa expire.we are working again to solve our problems.so we r looking information what I need to do now do we have to start whole process again or I just have to reply again for fiancee visa again? I was gone 24 july 2013 and I came back 18 oct .plz advise us .

Sounds to me like you will have to start all over again.

Will this time visa process will b fast or easy? Or it will diffcult.is it a negative point on my visa or case that I came back with out getting marry.is it a good sign that my petitioner(fiancee) will be same ?

Well, you did promise to them on the letter of intent that you intended to marry your Fiance within 90 days of entering the US and you did not.

I don't think it's a death kneel but you should be prepared to have a deatailed discussion to explain this.

I know if i were the CO I would want to see even more evidence of relationship.

How can they be sure that you will come true this time?

Maybe get married and go that route.

Ya as a proff I habe there id and joint bank account tht was impossible with out her.plus social security card and some of my post comes on her home adress I revive them.do we need to talk lawyer? Marry visa take lot time thats y we decided for k1 visa.we hope this time I got visa or we will have to marry in my country then apply.we r confuse.and one thing more if we dont apply untill feb 2014 she will have to visit me again.as uscis said tht fiancee must b visted atleast in 2 year 1 time. Now we worry do we get marry in my country or she apply again for k1 for me.trying to re search the fourm on webs for this information.or is it better she called uscis?

The processing time will be its own - a previous visa doesn't affect it, I don't think.

As for the fact that you said one thing in the application (that you intended to get married) and didn't follow through, I would think that would raise a red flag and could possibly get you denied. The spousal visa would show that at least you did get married and are serious about your relationship. As it stands now, you will have to prove the seriousness of your intention to be a couple and live together as one in the US.

Many people have a Social Security number (I do, for example) and it doesn't affect the visa process at all, so you can't count on that to help you. As for what you can do, marry or go the K1 visa route again, it really is your choice unless there is someone here that has been in a similar situation as you (and it is not a common situation, I don't think) and can give you their feedback. As for her calling USCIS, I would think there isn't a lot they can tell her aside from what we're telling you now. Just my opinion.

K1 and IR1 take about same time.. Not much of a difference.. Dont forget ISlamabad embassy famous Administrative processing that could be months to year.. take a safe route.. Have her come to Paki.. Get married than apply for IR1..
