Hello everyone! New to this site. Today I sent out the I-130 for my wife along with all the stuff, hope I did everything correctly! I reviewed it a 100 times, everything signed, personal check is ok right? Very anxious and patient for the beginning of a long process. Any ideas on how long (if everything goes well) that I will be approved and be sent on th the NCIS? what would you say are common mistake that people do for the I-130? I put in how I met my wife, relationship, future, had my parents both write letters, photos of us and marriage along with marriage certificate and traslation into english, visa page and stamps showing I go to Brazil often..lived their for around 2 years in Brazil on and off for the past 3 years. Do I have good chances you think?! E tambem estou curioso se alguma americano tava na mesmo situacao de mim?? Se com Brasil o I-130 e mais dificil, ou tem alguma coisa q voce sobe q vai me-ajuda..obrigado!!

I would be worried if your file goes to NCIS ;)

Generally an I-130 takes 6 months to a year currently I believe, from initial filing until it is received by the. NVC. These timelines fluctuate all the time, but there is currently a significant backlog. Congrats on having started the process!

Most common RFEs are for lack of evidence or bona fide marriage or discrepancies in the I-130 or related paperwork. Or sometimes missing paperwork.

The whole process usually takes 12 months average but it can takes longer. In my case it took 10 months and could of been less then that because we where filling the process abroad, so we had a delay in every packet that it was sent to USA.

Like Yang-Ja mentioned, "most common RFEs are for lack of evidence or bona fide marriage or discrepancies in the I-130 or related paperwork. Or sometimes missing paperwork", if prepared a good paperwork there is nothing to be worried.

Ahh ok! what would you say was the most difficult part in the whole process? Did you need policia federal clearance or anything? And any doctor work for the medical exam?

Yeah, I'm also in your situation. I'm American and my spouse lives abroad in Brazil. We've been married for a little over two years and have been visiting back and forth. I filed at the end of July and I am still waiting and waiting and waiting.... :(

It's not true that the I-130 is harder in Brazil. There are some other countries that have a higher instance of fraud. The only thing you can do is "esperar e esperar e esperar" :( Boa sorte

the most annoying part was at the NVC, because they sent RFE for ds-230 and affidavit of support, they requested the police clearence and affidavit support there was a error in it. At the medical exame I had to take a vaccine that was missing on vaccination card.

Yes, you need Polícia Federal clearance and Polícia Civil for each state where your spouse has lived.

But do not get it until you get your NOA2 because the police clearance is only good for 3 - 6 months.

Also, it needs to be translated into English.

Took us 8 months from filing to delivery of VISA but that was in Manila. Thanks to VJ I had all my ducks lined up in a row and all documents ready before they were asked for. God Bless

Darn. Was hoping the I-130 was the hardest part! Thanks for the feedback guys. :)

Sky-- are you on the NVC now? or still I-130 processing?

I-130 is the "easy" but lengthy part. It's where all you can really do is wait.

NVC is slightly more complicated, but generally goes fairly quick.

Wow David...that's the timeframe I am hoping to have...although I am aware it can be longer. My husband and I haven't filed yet (will be do so in January - I'm the Beneficiary) but I am learning sooooo much from the varying situations/ cases I read about on VJ. All the scenarios are certainly giving me enough information, and helping us to start building our case before we start.

I am happy for all who have reached the end of their journey, those nearing the end. For those like me who either haven't started yet, or have just started, I pray that we will have a limited waiting time to be with our loved onegoofy.gif .

April 7, 2014: Packaged received by USCIS

April 8, 2014: Received NOA 1

Sept. 17, 2014: Received NOA 2. Case APPROVED with no RFEs

Oct. 17, 2014: Case # Assigned by NVC (Same day case was received, according to Julian # calculation)

Oct. 21, 2014: Received letter from NVC

Oct. 22, 2014: DS-261 completed and submitted to NVC

Oct. 31, 2014: Paid AOS invoice


Dec 08, 2014: Sent in IV & AoS packages

Dec 11, 2014: Package received by NVC

Dec 12, 2014: Received email from NVC acknowledging receipt. I assume this is our scan date

Dec 25, 2014: Paid IV bill

Dec 29, 2014: Funds deducted from bank account. DS-260 became available, and was completed

Dec 30, 2014: Submitted DS-260

Feb. 12, 2015: Case Complete with NO checklist! whoot, whoot!

Mar. 25, 2015: Received P4. Interview

April 29,2015: Completed medical examination

May 13, 2015: Interview Date APPROVED :dancing:

May 19, 2015: Received Package

Oct. 22, 2015: Travelled to my new home :) (In order to get IR-1 Green Card) Expiration date on IR-1/CR-1 Visa - Oct. 29, 2015

Nov 10, 2015: Received Social Security Card

Jan 4, 2016: LPR Green Card arrived.

As we are not done yet, we cannot say what is the most difficult part in the process.

Yes she need get the clearance from Federal and Civil. Also if your fiancee was living in 2 or more states in the last 5 years, so yes need a policia Civil for every states she lived in during the last 5 years. My wife lived in 2 states but her home state was easy, she just had to go on the website but the other state she lived in required her to show up in person. I think it is good for 6 months so don't get it yet until you reach NOA2 stage.
