I went to immigration interview for an adjustment of status with my wife in October 2014

we have been married for more than 3 years,at the time of our marriage she was a green card holder.

she became a citizen this April 2014.

she filled tax for the year 2010,2011,and 2012 as single.

i could not work because i don't have SSN and could not filled tax as well.

The RFI indicate we must send her tax transcript for 2010,2011 and 2012.

Is her filling status as single going to affect the decision?

we have already filled an amended tax return, and waiting for response from IRS.

we are giving a deadline which is going to end on 02/01/2014

I need your advice. thanks

Since you said you filed amended I'm assuming you now know that you don't have to have a SS# to file taxes. You get an ITIN and it allows you to file taxes whether you are in the country legally or illegally. I am a registered tax preparer and I deal with that issue all the time.

The IRS will process the amendment but it can take some time. Usually 2 months is average. Best wishes!

Sorry, meant to add also in whichever years you were legally married she is NOT allowed to file single. She must choose MFS or married filing separately.

Thank God you amended all tax returns. That can be very serious. Regardless where you are once she married starting that year she needed to file married filing jointly or separate. But you will have corrected transcripts so no wahala. goofy.gif

To Yang-Ja Honestly i did not know i can filled tax while out of status. since i dont work and did not have SSN i thought i could not filled.

that was why she filled as single.

When you married a citizen all that was forgiven. You not workiung has nothing to do with her filing status. Since you had no SSN she could have applied for a ITN for you and filed jointly or filed married filing seprarte many of us do with spouses still overseas.

I am just saying this for others who may reference this thread so they know. Once you marry and do taxes you MUST file married. Do not listen to tax preparers or Tax accountants who tell you to file single. Heck even IRS folk don't know their own laws.

You amended so all is fine and you probably getting money back.

There are two agencies relevant here, IRS and USCIS. The IRS requires you to file married if you're married. The USCIS takes filing status into consideration when trying to determine if your marriage is bona fide.

If she told the IRS that she is single, the USCIS will believe she doesn't consider herself married. This is a big problem unless amended.
