Hi all,

Im new to this site and have been reading in a lot of forums and gained a lot of information but I wonder if anyone out there can help me with some questions.

First Im going to tell you all the background story.

Im Swedish and my dad is Swedish. For a couple of years ago my dad meet his current wife who is a US. Citizen. For about 2 years ago the got married and the started and have finished the immigration process for him. He is now living in the US as an LPR, a green card holder. Im now 20years old and we have just started to plan the application process for me and we think we are ready to send in the I-130 form. Since we don't want(can't afford) to hire an attorney we are doing all the filing ourself. Im turning 21 in the end of April so we are a bit in a hurry.

So now to the questions,

  1. What are we supposed to send in with the I-130 form other then the G-1145? I think that we have all the neceserry documents such as birth certificates and all. But do we need to send in the Affedivied of Support now together or is that a form for a later part of the process?
  2. Has anyone ever been using or drawing benefit from the CSPA? And how do you use it? Any type of forms?
  3. What other forms then the I-130 filing and later on the I-485 filing do we need to do? Like the D-260?

Hope some of you have been in our seat or know how to handle the situation. If one of you can/have the time to draw up an timeline schedule of what we need to do and when we need to do it I would really appreciate it.

1. Affidavit of support is not yet needed. Not until after the i-130 is approved, and sent to the National Visa Center.

2. According to CSPA, your age would only "freeze" if your dad becomes a US citizen before you turn 21. You're beginning to run very short on time!

3. DS-260 is the immigrant visa application, which you will file when the I-130 has been approved and sent to the National Visa Center. The I-485 is an application for adjustment of status. This is irrelevant in your case, as you'd have to be in the US to file it.

Why didn't you apply for a CR-2? If the marriage took place before you turns 18, you would have been eligible as the son of a CR-1 applicant.

Sounds like he was over 18 when they married, but an important factoid.
