I filed my ROC last week. I submitted photos of my USC and me dated 2008-2009-2010... She got divorced in 2010 with the final judgement, but separated since 2000 married only for 1 yr and filed for divorce in 2001. She taught all the while that shes already divorce all those years not til we plan to get married she went to get copies of the final judgement that she realized that the divorce wasnt granted, by the way, she became USC tru her mother. My question is do u think the photos i submitted it will affect my removal of conditions? Since she is still married at that time? We have a genuine relationship. Weve been together for 5 yrs, and married for 2 1/2 yrs. i submitted those photos to prove that weve together for 5 years.. Pls i need answers.. Thanks

Hello, I'm a bit confused as to what your question is but I think I can guess what you are trying to find out.

The most important thing is as long as your marriage is legit as of the day you go into it together and that as long as since then you have proved to have established a life together (i.e. joint assets, financial responsibilities, co-habitation etc etc), then you have nothing to worry about. I doubt USCIS is concerned with anything that happened before the marriage occurred. If USCIS cared about that, a of us who have relationships longer than the marriage itself wouldn't have any trouble getting a 10-yr.

The whole point of the ROC is that USCIS need to see solid evidences that the relationship is genuine besides this thing called "love" (LOL) so that they know you aren't evading immigration laws.

With that said, photos are suggested as an evidence but many here will tell you they are not strong evidences. And I can understand that because someone can easily Photoshop you are or spouse into them (the technology these days can make those seamless). I submitted photos for my ROC just because it's an evidence but it's at the bottom of my pile of evidences I submitted and I expect it will weigh a lot less than say our joint bank statements.

Hope this helps! Good luck!

ROC Journey:

4/24/13 - Submitted I-751 application

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

8/14/13 - Rec'd RFE

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

11/21/13 - Service request via Tier 1 submitted

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

Chill. USCIS will not bother about her previous marriage, as long as it was not involved in bringing an alien like you.
