File AOS and I-765 in a state different than the one he will be living and working in?

Hello,

My fiance and I just finished our K1 visa interview. All went well and we were approved! We will be going to the US in a month to stay at my mothers where we will have the wedding. Now, we ultimately will be moving to Washington where we want to live and work, but finances are tight and we would like to stay with my mom until his employment authorization certificate is approved and we can find and secure jobs before moving to Washington.

Now I'm wondering if it is possible to file the AOS and I-765 from a different state (my moms location) than the one we will eventually end up moving and working (Washington). If it is possible, what complications may arise? As far as I know the AOS requires interview and biometrics at the local office in WA but the AOS will not be approved before the Employment Authorization. Will we be in the clear to apply and get the Employment Authorization prior to moving to Washington? Please help!

Well...

Take a look at my timeline.

If I were you, I'd apply for the EAD and AOS immediately after marriage from your moms address and hang out there for 2 months until you card arrives. You biometrics will be complete. EAD when filed with I-485 is free.

Can you return to your mom's for the AOS interview and can she get your mail for you?

Good Luck.

Make sure you call them a few weeks after you submit the change of address form to make sure that USCIS updated the address in their system. I've heard of people submitting the address change form and it getting lost.

Just complete change of address form when you move. Simple

Thanks for your advice. Ideally I think waiting at my moms for some time would be best. However we aim to move to WA soon because we (both) need to find work ASAP. I'm just wondering if it's possible to file the AOS and EAD and then move before getting biometrics done. Could we get biometrics done at our new location or would they still want us to come all the way back to Florida to do them?
