I am a K1 beneficiary. Last October 03, 2013 was my interview. I went to Montreal along with my daughter who is a K2 applicant. After the interview we were told that everything about our application was alright, we are "approved" and our visas will be available in a week. I was handed a sheet of paper which contains the instruction on how to locate our waybill numbers and what to expect upon POE.

So we were thrilled that everything went well and so happy that everything my fiance and I worked hard for pays off. Since I only have a more than a week to pack and settle everything what I will leave here in Canada, I went straight from Montreal to my workplace to forward my 2-week notice, and submit to my landlord as well my advance moving notice. Lastly, we finalized our wedding plans, paid for everything and set a date. All of those were achieved that weekend, as my fiance and I were aware that we have to move fast and we did not have a lot of time

To my surprise, I received an email on the 7th of October, Monday from Montreal IV requesting for my daughter's original birth certificate and that I was placed under 221g. My world fell apart that day. Despite depression over it, I headed to the Loomis to send my daughter's Original Birth Certificate to the Consular Office.

Since then, I have not heard anything from them, it has been 5 weeks and a day now. No word from them, no one to call for inquiries. The people who answer calls from their provided contact numbers don't know anything. The DOS which my fiance often calls does not have any information too. I don't believe the CEAC site is updated or accurate. It says my case is READY, meaning ready to make an appointment for interview which is the step of the application I have gone through already.

The worst part of all is they are holding on to our passports, my fiance and I are really hoping we could be together this coming Thanksgiving. They did not even notify me if they received the document I sent although I had the tracking number which showed it was received the day after I brought it to Loomis.

I do not understand how we're told during the interview that we were approved only to find out that we were refused afterwards. I do not understand too why my daughter's birth certificate is a piece of information that is missing as they had always been requiring that document ever since I-129 F submission. Meaning I have submitted that document to them more than once. I don't even know if there is such a thing as a period of time the Embassy can legally hold on to applicants' passports.

My whole wedding event was called off and we lost a lot of dollars from cancellations. I am jobless without any income and my daughter and I have literally no roof on top of our heads at the end of this month. I am rapidly sinking deeper into depression each day which concerns my fiance so much. This has massively affected our lives in a negative way. I'm not sure how much longer I should wait. I just really pray I still have my sanity intact when our visas finally arrive.

Any input, advice, information, tips, encouragement will be greatly appreciated. Hoping to hear from concerned members soon. Thank you for taking time to read this.

I'm sorry about this situation, but things will probably work out for you! I don't have much advice other than keep calling the embassy and try to speak to somewhat of a higher-level employee. Surely they are working on it as they have your passports in hand.

We're actually aware of that, but refusal I thought should be done after the interview. Not tell applicants they're approved, and their visas are ready in a week, then they're not. Thank you.

I'm sorry for your situation. My husband has his interview next Wednesday and we already left notice for his father that we won't be renting his apartment anymore. He's been out of a job during the whole process of our case due to the idiocity of employers in the area - living off savings. I really hope the consulate doesn't do this to us too, NVC already screwed us out of a couple of months over one mis-translated word! :( So I feel you.

Just keep your head up, you're almost done with this! Also, you can call DOS for free using Google Voice on your computer if it makes you feel better. Have you tried emailing the consulate? They take roughly 10 days to reply, but 10 days for a reply is better than nothing. Hopefully you'll get some news soon. It's ridiculous what the government does. :(

In the mean time, do you have any family or friends you two can stay with as a back-up plan if it does take longer than the end of the month?

19/09/13 - 3rd checklist for Police Record, claiming nothing was attached to the email. Checked sent email- it was attached (downloaded to make sure the file wasn't corrupt, it was fine.)
01/10/13 - Case complete- finally!
03/10/13 - "The National Visa Center has forwarded your file to the US Embassy/Consulate General where you are applying for an immigrant visa."- recieved P4.
22/10/13 - Medical exam - Montreal @ Medisys - Time: 1h 50m Cost: $290 for exam, $20 for flu shot, $45 dtap. Total: $355. Score 6/10 - bad/insufficient office management.

04/11/13 - Medical papers in hand. Becareful, our package was in cheap envelopes stapled together...
20-11-13 - Interview - APPROVED!

20-11-13 - ISSUED but in AP.

22-11-13 - Issued - PRINTED.

25-11-13 - shipped.

29-11-13 - picked up. smile.png

03-12-13 - Flight to Vancouver to pickup the rest of our stuff from storage. Also our first wedding anniversary. <3

04-12-13 - POE Peace Arch - Pacific Highway

06/12/13 - Home

10/01/14 - SAVE contacted SSA office on our behalf and SSA accepted the SSN application

18/01/14 - SSN arrived

22/01/14 - Received driver's license.

24/01/14 - Green card received in mail!

Have your fiance call his congressman and get them involved, more times than not things move faster with a little push from someone more important than us.

Goodluck to your husband and thanks so much for the sympathy and encouragement. Yes, hopefully the embassy will not do the same thing to you so you can start a life together which is the only thing my fiance and I want so much to happen. But it is better to prepare for worst, they are so unclear and unpredictable, they did not even offer explanation why they asked for that document. Tell your husband to take all applicable documents with him in case they ask, that will prevent Administrative Process or 221g to happen. Thanks again and Goodluck.

I'm so sorry this has happened to you. Just fyi, your daughter's birth certificate was not needed in the I-129F packet, so they may have even thrown it away. That's why they needed it again at the Embassy.

I'm so sorry this has happened to you. Just fyi, your daughter's birth certificate was not needed in the I-129F packet, so they may have even thrown it away. That's why they needed it again at the Embassy.

Is your husband a K3 applicant? Is there a reason why he can't stay or live with you while he applies for K3?

Question for you all! So we received out NOA1 (my fiancé Jake received it in the US) is there any way to get the NOA2 mailed to me in Canada, rather than him in the US? He is having problems getting a mail key from his landlord and the post office said id he doesn't have it in a week they are going to start sending his mail back to the sender :( what do I do?!

Hi, they will mail the NOA2 to your fiance. And your fiance has to give you that NOA2 to take to your interview in case they ask. Consider calling the USCIS for a change of just his mailing address, maybe he has relatives or friends whose addresses he can use as his mailing address. He does not have to have the same mailing and physical address anyways. If he has a different residential address from his mailing address, mails will be sent to his mailing address. They will not mail it to Canada. The only time mails will be sent to you is when the case is forwarded to Montreal. Hope it helps.
