You aren't "out of status" anymore when you file for AOS while married to a US citizen. Also, to fly domestic they only need a piece of ID. You do not go through customs

make sure your ticket has same last name as your ID though, saves a lot of hassle!

Hi, thanks for your quick response,

I guess I am more concerned with the fact that on the interview IO will be able to see I have one travelling record in the system even if it is domestic. I read a previous post saying that his i-485 got denied because the IO saw the record online and believe that he traveled when the case is pending.. I did not even think about the little possibility of being sent into custody at the airport.. lol

With the upcoming interview (which I still do not know what date it will be), I am not sure if I want to risk. However, this will be the first time to spend Xmas with my husband's family after we are married..I know it means a lot to him :(

Filed: AOS (pnd) Country: Bulgaria
Timeline

While I was waiting for my interview notice, I was in your words "out-of-status" too, but I used my drivers license as valid government issued ID in order to fly 2 times (domestic). So u r fine as long as u have some kind of ID

08/02/2013 - received notifications for acceptance via mail;

08/08/2013 - received biometrics letter (appointment for 08/14) via mail, without any e-mail or text message notifications;

08/14/2013 - done with biometrics;

08/22/2013 - I-485 online status updated to "Testing and Interview";

08/28/2013 - I-485 online status says " On August 28, 2013, we mailed you an appointment notice for an interview for October 4, 2013...";

? It is not a crime to have a "travelling record."

You are confused about whatever it is that you read.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Hi Harpa,

Maybe I was confused..I guess the whole being "out of status" and travelling abroad equals abandoning application automatically really scares me.. however, since you guys and also my lawyer assured me I think I will fly domestically ! :)

And btw I have been waiting over 2 month for my interview since I got my EAD in Sept and it's still nothing.. You advised me earlier that I need to wait till the mid of Nov which is getting close lol I hope I will hear something soon.. (My case is in ATL, GA. I submitted on July 1th and they are processing cases submitted on Apr 9th according to the USCIS timeline...)

Thank you for your response, it makes me feel better hearing from folks who went through similar situation!

Travelling abroad, without having approved AP, will cancel your application. You are not travelling abroad, and you have an approved AP, so that doesn't apply to you in multiple ways.
