Hi all,



i'll be sending my application next Monday. i have one question. My husband and i just moved to a new apartment in Dec, 2012. i have the lease for the new apartment, but i couldn't find my the lease for old apartment. Do i have to have the old lease for the application?

Lease is an important evidence of joint living- try to get a copy of the old one. If not explain the situation in your cover letter and just send the latest one. If all the other evidence is fine, this should not be an issue.

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

When you say you couldn't find it, do you mean you misplaced it or don't remember signing one with both your names on it? If misplaced, maybe you can ask your landlord/property manager for a copy?

Do your old utility bills show both your names? If not, do you each share responsibilities for different utilities (say your name is on the electric bill and the spouse is on the water bill etc.)? I would submit those utility bills anyways independent of the old lease as that's extra evidence to show co-mingling and co-habitation.

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

for ROC, is best done to send off monthly journals of financial co-mingling,

from date of receiving first green card, to yesterday.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Absolutely - they help as long as those are in joint name or at least one utility in each name. It then adds credibility to your statement that you lost the lease agreement.

Are you sure you can't get a copy from the old landlord! Explore if he has one and is willing to give you a copy.

I wouldn't worry too much if I were you! There are countless of couples who didn't submit their old joint lease agreements and got approved.. Like others have said , just make mention that you lost it. If you really feel the need to have it you can ask your previous landlord to sign a document that states that you guys were old tenants from whatever year. In my opinion old utility bills along with your current joint lease agreement and other supporting documents should suffice!!! (FYI hubby and I did not submit old lease as we submitted the original with AOS packet- we have a copy of the lease but unsigned and did not include in our ROC pkt)

Monthly. Each Month. A monthly journal, showing the financial co-mingling done each month.

Sure, a piece of that would be the monthly bank statements. Then there's utility bills, shown for each month (well, that's what a monthly journal would contain, stuff for each month).

I think yer getting the idea now.
