Okay, much clearer now.

To directly answer your question in post #1, based on my direct experience I think this case will expire out and I wouldn't wait on them. I didn't.

NVC does not review K1s on the way out and I doubt that they will review them on the way back. They act like some sort of clearing house for K1s.

For what it's worth we got deneid a K1 1 year and 7 days ago exactly today and my Wife has now been here now on a CR1 for 6 weeks (GC in hand).

When this happened to us I researched VJ and other immigration sites and then studied many email responses from USEL, they told me the same thing

"In most cases DHS/USCIS will not contact you upon receipt of the petition because of the short validity period of K-1 petitions. You are allowed to file a new petition, or marry Applicant and file for him to immigrate as your spouse."

I decided to take that path.

I received the expiration notice the same week or so on getting my NOA1 for the I-130.
