In Admin Processing at NVC

Good Morning VJ

I have searched the internet high and low for the answer....I have made numerous calls for the answer....with no luck so maybe someone on here can shed some light...

After our interview at the Lagos Consulate in Nigeria we were put on adminstrative processing for not being able to prove bonafide relationship...Our petition was sent back to the states to NVC...I understood that all APs were sent to USCIS to be reviewed....and I know of another case same time as mine that has been forwarded to USCIS....I keep calling NVC and get the same answer they have recieved our case ....It was recieved at NVC 4 weeks ago and that it will stay at NVC...and not be forwarded to USCIS....I told them I thought all were sent to USCIS and there answer was who told you that they dont know what they are saying...that AP could be done at USCIS, NVC, or Consulate....

So my question is what is the difference in your case being in AP at USCIS or being in AP at NVC?????? I want to know if this is a good thing or not.... Im so confused....

Contacted the congressmans office they dont want to be bothered with such issues.....My case status at NVC says administrative processing so I thought that is what AP was and when I contact NVC that is what they told me too ...but they havent always been truthfull about things

You are not in AP, the visa was sent back to NVC for review where they will most likely let it expire.

I agree completely. This happened in our case when we filed for a K1. My husband, then my fiance was placed on AP and I did contact the congressman, who in our case was very active in our case, they tried but said the last word belongs to the CO. Nothing can be done about the case. It came back to the states. Neither NVC or USCIS knew where the petition was for a while, then I received a letter saying the petition had expired and we were to file another K1 if we choice to. I filed for FOIA and that did not clarify the situation either.

To make a long story short, instead I made another trip to Lagos, got married and came back and filed for CR1 and after a year and a month my husband finally came home. You could chase a ghost and it might or might not pan out. Sorry for your heartache. It is one I can relate to very well.

I would suggest, going the CR1 route specially dealing with Nigeria. The petition probably has expired and they will let you know soon in a letter. If you choose to do the CR1 which is a petition for a spouse, then do your homework here on VJ and get your paperwork ready, your evidence stronger and make sure you show more evidence that you two have spent more time with each other visiting, communicating, meeting his family and friends, take plenty of pictures with them to send in with your petition.

Patience and endurance are needed if you are to proceed. This is a long journey and it will work itself out at the end but you are in for a long race. Get ready and good luck!

just wonder why they say that you not able to prove bonafide relationship? what did u show them ? I'm just wondering because my fiancee will get his interview soon and kind a nervous especially being on middle east..

Depending on the country you are from, they look at the norm and the culture and evaluate how your relationship has progressed and developed. Does your family know about your fiancee? have they met? do your relatives, friends and neighbors know of your ongoing relationship? Do you have photos to show of meetings, celebrations, traditional ceremonies and interaction with each other? they look for letters as well from family and friends who can testify of the couple's ongoing relationship.

They also look at an ongoing correspondence and continued connection between the couple. They want to see visits and how long each visit was for? what did the couple do during that time? The more time the relationship has been going on the better it is. One has to support the relationship in proof. That is what they mean by "proof of bonafide relationship".

Support the petition with evidence and organize it well. Follow the guidelines here on VJ and ask if you need help. Good luck!

I haven't heard of this before until now.

What I've heard of and happened to us was that "our petition is being returned to USCIS with a recommendation for revocation".

Did you read this on a letter that they gave your SO?

here is a copy of our 221g

Dear Visa Applicant:

This office regrets to inform you that it is unable a visa to you because you have failed to convince the Consular Officer that your relationship with the petitioner is bona fide. Your case will remain pending under section 221(g) of the Immigration and Nationality Act while it is returned to the National Visa Center for their review. When their review is complete, they will contact the petitioner, who will have then have the opportunity to respond. If the case is reaffirmed, we will contact you to set up a new appointment date. If the case is not reaffirmed, the petitioner will be notified and the National Visa center will close the case.

I apologize the letter says we are in review and the nvc site says we are in Administrative processing....What ever it is we are in LIMBO....

And this is a copy of the email from Lagos Consulate

Dear Ms. XXXXXX,

Thank you for your email regarding the immigrant visa application of Solomon XXXXXX.

This case will be returned through the National Visa Center. It will take several weeks for DHS/USCIS to receive and determine action on your petition.

In most cases DHS/USCIS will not contact you upon receipt of the petition because of the short validity period of K-1 petitions. You are allowed to file a new petition, or marry Applicant and file for him to immigrate as your spouse.

We advise you contact DHS/USCIS with any additional inquiries as the case is considered closed in Lagos.
