How necessary is an attorney in an AOS case

Hi guys,

Me and my fiancé are planning to get married and thereafter file for AOS. We've been together for two years now and we recently just got engaged. My question is how helpful are attorneys generally in this case? I came in on an F-1 but I'm currently out of status and I feel there maybe some complications due to that, that would require the expertise of an attorney. Any help would be appreciated. Thank you

This is a DIY site so most people here do not use an attorney. Overstay is forgiven when you marry a USC so that alone should not require an attorney, unless there are other issues (criminal charges, drugs in background etc). Using a lawyer is also expensive and can slow things down. hat being said, if you have red flags or you are ust not good at filing out detailed forms, then an attorney can be a good idea.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I agree with the above advice. Do it yourself. I AOS'd from F-1 also and its not as intimidating or risky as most attorneys would make it seem. This site is here to help you with the process.

You will be fine- your case is not that complicated

Removal of Conditions (9 months 1 1/2 weeks or 285 days)

04/19/12 - Sent ROC Package

04/26/12 - Hardcopy NOAs Received

I also meant to say one thing, but I forgot. I'm in an interracial relationship, I'm black and my USC fiancé is white, and I've often heard of couples like us being subjected to obvious prejudice. Any body has any similar experiences?

No issue within the USA. If you were interviewing in another country, and it was very unusual in that country, it may be an issue.

Just from my own personal experience, I used a law firm just because I was not sure what to do but I have to say though I'm glad I did because I learned from the process. I'm doing the ROC on my own and it's just much easier for me now.

ROC Journey:

4/24/13 - Submitted I-751 application

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

8/14/13 - Rec'd RFE

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

11/21/13 - Service request via Tier 1 submitted

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

Not at all; Im Jamaican (im brown) and hubby is Puerto Rican (he looks like a tanned caucasian) ... we had no issues btw but we got more positivity than anything, like the "aww you guys are adorable" m0786.gif lol

P.S. interracial relationships have become the norm so you have nothing to worry about. All the best
