Hi All,

I have a question. CR1 visa has been granted to my spouse but because of some marital problems we would like to end our relationship. Is it possible for me to inform the immigration authorities if my spouse still decides to travel to US. Is it possible for my spouse to enter into US even if we end up our relationship.

Sorry this has happened to u. My opinion is , since u both were not divorced yet, still your spouse can enter into USA. but if u apply for divorce after your spouse enters and get one within 2 yrs of conditional residence, your spouse should leave the country , the GC wil be cancelled. But if u inform the immigration authorities that u gonna divorce and stil ur spouse wants to enter, u may be questioned. be prepared for that. Anyhow if u decided to end up your relationship, ther is no point of your spouse entering into US , your spouse wilbe sent back to his/ her home country. better think before u take any decision.

The spouse can enter while you're not divorced. But they could have problems proving an ongoing relationship when removing conditions from the visa in 2 years (if it's a CR-1).

It doesn't sound like immigration fraud to me either. Maybe you two could still work it out. Good luck w/e you decide to do. If you revoke it in a hurry though you might regret it later if you fix your relationship because then you'd have to start over.
