Applying an AOS in US

Hi everyone,

My husband filed an I-130 this Sept 16, 2013 for cr1 visa. After reading several cases in this site,

have learned that it will took an average of 8 months & some got approved more than a yr.

We have never expected that this application will took this long.

My question now is, since I'm holding a tourist visa, is it ok if I just go to america & just filed an AOS there instead?

Will this be a problem?

As advised in previous posts, do not do this as it constitutes visa fraud and you will banned from the USA.

Like others before me said, it is illegal to use a tourist visa for the sole purpose of entering the US to adjust status.

Lets say you dont care and you try anyway. What will you say to CBP officer at POE when you are asked why you are travelling to the US? If you tell them you are there to AOS, you will be put back on the next flight to the Phillipines.

If you lie and tell them you are just visiting your husband, and then file for AOS... that lie could come back to bite you in butt when you AOS, worst of it being AOS not being approved and you deported.

If you have a tourist visa, just visit your husband for a couple of months, but come back to finish the process at home. You are relatively lucky with having filed in Sep. USCIS have started to move things along and hopefully you wont have an 8 month wait ahead of you.

***All posters in this thread who posted that use of a tourist visa with intent to immigrate is fraud are correct. Since visa fraud is a violation of Federal Law and condoning such fraud is a violation of the TOS, this thread is now closed.***

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
