I-864 question

I have read that sometimes it is still needed to have 3 years of tax returns. My 3rd year was below the required income level. I work a full time job and have a small business which using deductions brought my income level below what is required. This last year and when I file this spring will be above what is needed. Will I need to include assets when filing out I-864. Fiance will arrive in april. Will this years income taxes be main consideration in dealing with AOS

Do not count deductions. See is you can use I-864EZ first, Use your Gross income before deductions.

Include past 3 years, even if income 3 years ago is below 125% poverty line, they are concerned with your most recent year of income. Also include a note from your employer, and several recent pay stubs.

They will look at your CURRENT income ie: most recent tax year when determining if you meet poverty guidelines, like Yu&Dan said, it is based on GROSS income, not net income. You can include the previous 2 years income tax returns with your I-864 if you feel that it will make your case for being able to support the immigrant stronger. So if your GROSS income is below the 125% (on your last tax return), you should include assets as well if they will bring you to the 125% mark.

This states that if you are self employed you must check no and cannot use I-864 EZ I am both self employed and work a full time job. So how best to proceed?
