SSN request denied after 89 days - Help?

Well thanks to everyone at VJ, my wife and I and her son are together and living almost happily in Kentucky. On the 87th day of her K1 VISA, we went to Social Security office and requested a SSN for her and were denied because her I-94 was going to expire soon.

We made an appointment to go to the field office near us with USCIS and they told us that because the I-94 was expiring soon, that SSN could not be obtained without doing something.

I don't remember what that was supposed to be.

Has anyone else gone past the 90 days before applying for a SSN? Do we file AOS then apply for SSN or take a completely different approach.

Help???

I believe you need to wait to do AOS now. You two should have got an SSN for her a couple of weeks after she arrived.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

Yep, you missed the window. VJ mentions this in the SSN guide. You should apply for AOS and when she gets her EAD you can get a SSN,

You would have had to apply until two weeks before your I-94 expires. As others have said, you will now have to wait until she gets her EAD in the mail.

the problem is (like my case) SOcial Security requires an EAD for you to have an SSNumber. 90 days have passed (i94 alreadyexpired last month) and i still dont have my EAD so i cant apply for a SSN. this is a gray area on K1 visa. i hope USCIS gives you a right to apply for an SSN without EAD under k1 visa application.

K1 Visa: I-129F sent: 12/12/2012; NOA1: 12/19/2013; NOA2: 4/15/2013; Interview: 6/19/2013, Approved; US entry: 7/23/2013; Wedding: 8/12/2013

EAD: I-765 sent: 9/6/2013; NOA1: 9/10/2013

AOS: I-485 sent: 9/6/2013; NOA1: 9/12/2013

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

That's what I was wondering... It's no "gray area", the rules are pretty straightforward actually. You would have simply had to apply for an SSN until two weeks before the I-94 expired, and you would have received it. Now you'll have to wait until you get your EAD.

I applied for my SSN two weeks after entering the U.S. and didn't have any problems.

There is no gray area, it is black and white.

Black: Apply for SSN after arrival up to day 76. No EAD needed during this period.

If you wait until after day 76 (note: some HAVE applied around day 80 and gotten theirs, but it's probably rare):

White: Now you must wait until you have an EAD card in hand.

See? No grey at all.
