So what should we do? Should we just go to the local police, pay the fee, show our passports and hope no one notices the expired visa? I sure hope that it's that easy.

Why don't you call the local police department and ask them if they can take your fingerprints and run a background check and if so, how much does is cost and what is required? If they ask what it is for, explain "It's an application for a permanent residency in a European country. Since I lived here in the US, I need a background check from here".

I doubt they would need to see your passport and they have no need to see your visa or know anything further regarding why you need the background check. If you have any other piece of identification, show that. If they cannot do it, download the information from the FBI fingeprint record request and send it to them. It takes about 4 months.
