Thank you again that makes alot more sense to me now....Solomon has been on me to just move to Nigeria while we go thru this process he understands that will be hard for me since I have 2 sons and a granddaughter here...if the granddaughter was older it wouldnt be such an issue for me....We thought about legally getting married in South Africa when we were there but I was told it would be a sign of desperation and we would be denied and this was by a lawyer...So we had a life commitment ceremony which isnt a legal wedding....So while we are waiting admin processing and the FOIA I filed for the COs notes I will go to Nigeria and have a great time to treasure...

oh yeah is there a difference if your file gets sent to NVC for admin processing or USCIS....I was told by NVC my file was staying there and then I read they get sent to USCIS....I havent gotten any notices for anything...just a copy of the 221g...its been 2 months this week

They xay NVC but it all gets sent back to USCIS and possibly to sit and expire.

Don't count on anything to be presented with your FOIA request. Those are worthless. The only time you ever get to know why the CO denied is when you get a NOIR/NOID there they have to list specifically the points for denial than the applicants can address each point with evidence. And this is usually only privy to CR1/IR1 folks.

Sorry but the lawyer was an (trying to be nice) misinformed and I bet don't know 9ja at all.

And trust me i understand the wanting to be with your love but have obligations and family here (I have 5 grandchildren I know).

Just go get married refile. Hopefully by vthe time you refile this logjam of a wait will be faster and 2014 can find you two together.

Just remember its just an obstacle, not a road block. A delay to your plans nothing more.

When its olderwoman younger man K1's just won't fly in Nigeria. They want to see commitment. So do as they say marry. And hopefully this time next year you will be awaiting an interview or done.

Look at our own Gowon how that man move chop chop and married filed and now home in US with his Empress.

And you know especially for Nigeria meeting the Family is of utmost important very few get approved not meeting the family. I have heard that some CO's look at beneficiaries not living in their country and interviewing a way to circumvent (Hide things like other wife, kids stuff like that) so they really want you to meet family, friends, neighbors.

I couldn't agree more and we've seen this more and more on here.

If you can afford to go to Nigeria and wait while you do the paperwork, I surely would. I think showing that level of commitment would be impressive to the COs. But it's very sad that an American citizen would have to leave their home, job, and family just to try and prove to someone they were really married. I understand the reasoning behind needing proof but it makes such a hardship on sincere couples!

Thank you all for understanding my problem and giving me advice...there are alot of things web sites and other reference places dont tell you.... that is why i believe human experiences are the best....anyone can sit on a computer and look things up and find out later some of the info was outdated and ect....So thanks for being patient and giving me some of your time and experiences because I feel Im learning from the best people that could teach me and that is You here on Visa Journey

HI...my background is filed fiance visa... denied and put in administrative processing....if we get legally married while im in his country visiting him and come home file spousal visa....cause consulate sent me a letter to refile k1 or get married and file spousal ..... what are the chances of him being able to come here to the US to visit on visitors visa while waiting for the spousal visa.....he is from Nigeria and yes I do know he is from a high fraud country....thank you any answer would be appreciated

Face time for those of us going through the Lagos Consulate is really important. Face time in Nigeria is even better! If you have the opportunity to go and live with your fiance/husband in Nigeria--DO IT!

This is just my personal opinion and advice, based upon my own person experiences.....

A cross cultural marriage is no joke--it's hard. Nigerians do not think or react like Americans. Living in Nigeria will allow you to understand his culture and family in a more intimate way. You are asking him to move away from his home country--why wouldn't you do the same for him for a short amount of time? Your personal emotions living away from your family during this time will help you understand his feelings when he comes here to live away from his family and friends. Your experiences in Nigeria as a minority will be eye-opening and give you a better perspective on how he might feel living as a minority for the first time in his life. These are a few of the key reasons I recommend you going to live in Nigeria for a short time--but there are many more.

For the record, my husband and I spent the first two years of our marriage in Nigeria. Then two years apart during the visa process (with me here and he there). And now he has been here for two years. We will likely be moving back to Nigeria in the next few years while maintaining our home here in the States as well.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It said something like cant issue your visa at this time couldnt prove bonafide

relationship petition being sent back for admin processing due to time limits

on k1 that our options are refile k1 or get married and file spousal.....we

think it was because we met in South Africa instead of me going to Nigeria

to meet his family it was the only thing he said the CO made extra comments

about besides the fact Im a cook/bartender ...she went as far to tell him I

dont make much money even tho i make $30,000 a year which is above there

guidelines so we are lost and dont really know what to do

The above you wrote is very unclear.

You can't be waiting in AP and at the same time your case is being returned. It's one or the other.

Cases are returned via NVC with final destination USCIS and your service center.

If you filed through CSC your returned case will expire and you may or may not receive a hard copy saying you can re file.

Under your circumstances travel to Nigeria is necessary to convince the CO of a bona fide relationship.

You can marry there and file the CR1 or re file a K1.

Your income depends on how many are in your household and it is sufficient for you and him if there is no one else

living with you.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
