Joint sponsor question

Hello all,

I'm considering asking my uncle to file a joint sponsor for my fiancee visa. I already meet all the requirements for a sponsor but I don't have 2013 tax returns to prove it and so I want to be cautious in case the CO insists on income tax returns.

Some background: My uncle had sponsored my dad on 2007 when we filed for family-based immigrant visa. I accompanied my dad along with mom, a brother and a sister. Since then, my brother and I have already been naturalized.

I'm not sure how he should these answers:

  1. Q8: The following persons are dependent on me (whole/partially): Should my uncle list the dependents he added when he filed for his taxes in 2012? Should he also list my dad, mom and sister since they still have not been naturalized?
  2. Q9: I have previously submitted affidavits of the following persons: Should my uncle list my dad AND his family who accompanied him? Or should it be entry for the entire petition?
  3. Q10: I have submitted visa petitions to USCIS on behalf of the following persons: Should my uncle list my dad AND his family who accompanied him? Or should it be entry for the entire petition?

Basically the question is the same, I'm not sure if my uncle should list just the primary beneficiary of his 2007's affidavit or also his family.

i think since you're saying you meet the all the reqs, dont even worry about making your uncle co sponsor and go through the headache and the what-if's. you submit your most currect three years, you can get a letter from your employer to show that you are and you will be employed with no intention of them firing you any time soon, and you can write a short letter and attach that to your previous years' returns stating this is what you have now and you will have 2013 in few months but if needed you can get a co-sponsor. worst case is they will ask for a co sponsor and that you can deal with the extra forms. I barely met the poverty line BS and i was still able to bring him over with only what I make. I might need one for his AOS though, Im not sure :) so yea, dont stress over it if you dont think you can find the right answer. also, with not being sure about it, there must be a time limit on those sponsorships, no? its been almost 6 years for your uncles sponsorship of your family, and you guys have become citizens already, and im sure your other family members have jobs and insurance and all that good stuff, so I dont think he needs to list you guys or parents on the form when it comes to that.

also, with not being sure about it, there must be a time limit on those sponsorships, no? its been almost 6 years for your uncles sponsorship of your family, and you guys have become citizens already, and im sure your other family members have jobs and insurance and all that good stuff, so I dont think he needs to list you guys or parents on the form when it comes to that.

The Affidavits of Support are in effect until the sponsored immigrant complied with 40 quarters of work, became a US citizen, or passed away. There is no time limit. If the sponsored immigrants don't fit in these, they still need to be accounted for in the forms, as the Affidavit of Support is still in effect for them. It doesn't matter if the sponsor doesn't put them in his taxes as dependents, and it doesn't matter if these sponsored immigrants have their own jobs/sources of income.

In this case, because only the OP and his brother have become citizens, the uncle would still need to factor in the OP's father, mother and sister, along with any other household members, himself, and the newly sponsored intending immigrant(s).

OP, if you earn enough on your own, I would second the suggestion to not bother with a co-sponsor. It's less hassle and paperwork, anyway.
