American Girlfriend And Argentinian Boyfriend

Hello I am (22) from Argentina (Tucuman) my girlfriend (24) lives in California United states, and we want to get married so we can be together. Although I am the one who wants to move to her country.

My doubt is the next one:

The last time we were together was on 9th August 2012, since then she has been studying and I've been trying to find a decent job. Our plan would be to wait until she gets her BA degree (on May 2014) so she can get a job and submit the "affidavit of support" for the Visa K1, now the problem will be that at this point the date will be almost two years since we met for the first time and I believe it could mess up everything.

We don't apply for the Visa K1 right now simply because my girlfriend is a full time student and she wouldn't be able to find a job that sustain the
"affidavit of support" requirements.

Probably we'll have to meet one more time to increase this 2 year period and to gain more proof of our relashionship?.

We've been building this relationship for over 3 years already. I am tired of waiting and the main problem is and will be "Money".

Anyway, I would apreciate your experienced and honest advice. I would also like to thank you for all your time to read about this topic.

Yes, it is a requirement that you have met in person in the 2 years prior to filing the I-129F petition, so you do need to factor in those dates. You can always plan another trip between now and when she finishes school, and that will take care of that. As for the money issue, does she have student income? That could be one way to get around it. The other way is for her to find a co-sponsor as many Embassies will accept that. The co-sponsor will have to make above the poverty guideline for their own household plus you.

There are ways to get around the money issue, if that's your only problem, it's not the biggest deal. You having met in person is much more important, as if you don't meet that requirement, the petition will be denied.

If she can find someone to joint-sponsor with her for the I-134 (and subsequent I-864 for AoS) then you could file ASAP.

If you're waiting for her to get a job before you file, it may be more than May 2014 until she has one. At which point, you may want to wait until you know more about her job/salary and whether it's going to be after your 2 years of meeting last, and plan another trip accordingly.

Or, you file the I-129f in May 2014, and hope that she has a job by the time your interview comes around a few months later, but negate the need to meet again. The 2 year meeting requirement is for the I-129f petition. If you file that in time, then you find you haven't met for 2 years at the time of your interview, then that's no problem.

She won't need to provide you the I-134 until after your petition is approved, so she'll have a couple of months at least from filing to find a job (but that's risky, so she should find a joint-sponsor who'd be willing to help if she should fail to find appropriate work).

Well, money is a main issue for me since I can't afford a ticket to USA, not even a ticket to Buenos Aires. The amount of money I get with my job is a joke, and I've trying to find a better job since over a year already.

I guess, it's inevitable that we'll have to be few years more apart, working hard to make it work sad.png

She can fly to Argentina instead?

If she can get a co-sponsor or you cant get a USC co-sponsor, that would work too. that's for your I-134 for interview stage

If you get married in Argentina, you can't do K1.

I don't know what the use of applying for the K1 visa while she is in Argentina would be. She can go visit you, and you can prepare the petition packet together so that she can go back home with all your signed forms and whatnot. Then she can mail the petition as soon as she returns.

Marrying there would NOT help if you're going for a K1 visa. This visa is for fiances, and has the requirement of marryinhg in the US within 90 days of date of entry. If you marry first, you will not fulfill these requirements and must apply instead for a spousal visa. With current timelines, the spousal visa is taking a few months longer to process. It is cheaper though, in the long run. You have to do your research and figure out what's best for your particular case.

Yes she can send away the paperwork while she is visiting you. The mailing costs might be rather expensive though and it might be easier to wait or send it now.

I suggest she finds a joint sponsor to help her with the I-134 and then either get a good job or the same sponsor for the I-864 when you AOS after marriage.
