g-1145 probably a stupid question

I am US Citizen. Current wife came on Fiance Visa 2 years ago. We are just now sending in the AOS paperwork.

On the g-1145 it asks for name of Petitioner/Applicant. That has me confused. Me, the US Citizen, is the Petitioner and my foreign wife, who came on a K1 Fiance Visa is the Applicant, correct? So which one of our names do we put on the g-1145?

petitioner and applicant are the same. that was only you( US citizen) . Your current wife is beneficiary. have to put your name ( US citizen ) in that form. Good luck!!!

Wrong. The petitioner is the US citizen the applicant is the beneficiary, who is your wife

Your wife is the petitioner/applicant since she is the one applying to adjust her status. Really she is just an applicant, as she is not filing a petition for anything. That form can be used for more than one type of form. Your part in all of it is just to provide the I-864 and supporting documentation as her USC petitioner/sponsor. You were the petitioner for her K-1 visa by filing the I-129F.

Your wife is the petitioner/applicant since she is the one applying to adjust her status. Really she is just an applicant, as she is not filing a petition for anything. In the Family-based AOS part of the immigration process, it is the new spouse that is applying to adjust status to that of a permanent resident of the US. The USC spouse does not have to adjust status.

No. There is no petitioner/beneficiary scenario with the adjustment of status phase. This is a whole new process and not the same as the K-1. The foreign spouse is the applicant. They are already in the US.

Ok... so since we will put her name on the g-1145 should I assume that it should be her name at the bottom of the cover letter on the whole packet.... I.e. Dear USCIS, Me (the foreign) am petitioning for AOS... and then her name and signature at the bottom of it?

One last question... I'm going to Fed-ex it today to arrive by noon tomorrow. The medical we had done last year in the US was done on 11/14/12. Do you think they'll make her get another medical? Tomorrow is 11/14/13... so?

Yes, though some have both sign the cover letter too.

They may have her get a new medical since the receipt date on your I-797C will perhaps be after the 14th. You will just have to wait and see if they send an RFE for another one.
