Had my interview 160 days ago .. still no luck yet .. its even has no update unless we send an email to inquire about our case .. does it help if me and my wife hire a lawyer ?? We are half dead and seems to go forever .. called dos and they cant tell us anything only that our case pending administrative processing .. please help :(

I don't think a lawyer would do you any good at this point. Have you or your wife asked your congressman for assistance? Other than that, from what I understand, there is not much you can do asides wait for Administrative Processing to complete. You can try to contact the Consulate/Embassy to see if they will release any information as to where they are in the process but I don't think you will have much luck.

What do you think a lawyer can do? The answer is nothing. There is no way to expedite AP, it has to run its course. The only thing you can do is have your senator or congressperson inquire on your behalf. My husband had AP in Amman, we inquired via email once a month. Good luck and I hope it's over soon.

We contacted the congressman but he wasnt able to help .. but we did not contact the senator yet .. mimo .. do you remember me ? I am the one talked to you months ago .. we still undergoing thru ap .. hope this hell will end soon :(

Yes too many times and we get the same response from them each time we email them that we have to wait cuz our case is still pending ap .. but 3 weeks ago my wife emailed them snd they did not response back .. i also emailed thrm 5 days ago still no reply from them .. its wired :( .. we contacted the congressman and he could not help .. its the time to contact thr senator and get him involved ... hope our ap will end soon .. :(

You can file a writ of mandamus to force the bastards to do their jobs.

Ummmmmm...not good advice at this point at ALL. That forces the embassy to make an immediate decision, and if AP is still pending it will be automatic denial. The OP has been in AP less than 6 months, not long as far as AP goes. If there is a denial for a cr1 there is no appeal. Before you advise people to do something like this, you need to get your facts straight. This is very dangerous advice this early on!!!!!

If the writ of mandamus even goes through, that just means they need to make a decision within a timeframe (I think 60 days?) so if the security checks and whatnot aren't complete by then, they'll just deny the visa since they ran out of time and need to make a decision. That's the risk you take by trying to force them to hurry up.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

It won't go to court immediately, they will try everything not to let that happen as it looks very bad for them. This will put the fire under their asses to get it done. Personally, if they are going to keep my case in AP after all the waiting I have done for more than a year they can keep the damn visa, I'll leave this god-forsaken country and never come back rather than deal with that. If it gives a chance of a faster process, I would do it if I was at 6 months (and AP is only supposed to last for a few weeks so 6 months is way too long).

You seriously misunderstand AP.

There is a rash of very unhealthy and angry people on VJ lately.

Care to explain how I misunderstand? And with how great this process is I can't possibly imagine why anyone would have a complaint.

AP is to protect the country from "terrorist". Depending on the country you are from, your religion, your travel history, and your name, and your personal history it can be short or long. As milli said filing a writ of mandamus can backfire as it only forces them to make a decision, not one guaranteed to be in your favor. The government will not admit someone to the country if there is a question as to their being a "terrorist". You speak of bad PR for taking so long to process visas but think of the bad PR is they admit someone who comes here and kills thousands of people.

AP, while I don't agree with the methods, has a good intention at its heart.

AP is not about someone being lazy and "not doing their jobs." It is about security and extra checks as belinda described above.
