Hi! I wonder if it differs depending on the POE, and whether it's a land or air entry. I entered December 2012 by land, which seemed fairly recent to me - but they may have changed the use of I-94's since then. I also received a new I-94 stapled in my passport the first time I used my advanced parole card at an airport in June 2013 - but not when I entered by land in July 2013. It may be inconsistent for K-1 entries too. smile.png

I think any minor issues that I have had going through the website, guides, forums, etc., have been addressed in the comments above. I would just emphasize the issue of the I-3025 to I-693 Civil Surgeon requirements for those adjusting from K visas. There are a lot of recent posts about this and many people are still confused. Other than that all I can say is thank you for an amazing resource.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Perhaps the guide for AOS from K Visas could be modified from this: 11. I-693, Medical Examination of Aliens Seeking Adjustment of Status.I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy).

to include:

3. What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

a. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or as a

b. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and

c. You received a medical examination prior to admission, then:

(1) You are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination, and the medical examination did not reveal a Class A medical condition, or if you did have a Class A medical condition, you received a waiver of inadmissibility and have complied with the terms and conditions on the waiver.

(2) Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit the vaccination record and page 1 of Form I-693.

Is the K-3 ever processed without being converted to a CR-1 along the way? In the notes THIS should be mentioned about the K-3.

I second the suggestion to include in the comparison chart that at this time, the K3 is not going to be any more expeditious than the IR1/CR1 since the current policy is to process the I-130 and I-129F alongside each other. The guide suggests that the K3 has an advantage over the IR1/CR1 in terms of processing time, but in practice, this isn't happening. Would help with all the "K1 or K3" questions that pop up in the "What visa do I need?" forum.

Suggested wording: At this time, K3 visas are rarely issued due to USCIS' policy of processing the I-129F and I-130 petitions concurrently. The approved I-129F petition will be adminstratively closed at the NVC and the case converted to an IR1/CR1 instead.

ETA: Perhaps this could be included in a separate box labelled "Additional Notes on K3" similar to the DCF addendum.

Another suggestion is to remove the addresses in the sample letter of intent to marry for the I-129F (K1) package. Lots of people get confused over whether it should be the address of the intake facility or a particular service centre, when an address really isn't required at all.
