Can I do my Medical Exam for AOS before our marriage?

Hello,

This website has been so helpful so far and I am sure I will be using it a lot more in the months to come.

I would like to start with one question for now :

To sum up, I am a UK Citizen who came on vacation on the VWP to see my US boyfriend last month. To cut a long story short, after living a long distance relationship for most of 3 years my boyfriend asked me to not go back home to the UK this time and stay here with him in the US. After a lot of thought and realising how miserable we have both been being apart, I agreed to stay and we have decided to marry and then apply for AOS afterwards so we can stay here together.

I've read quite a bit about the paperwork required which has been a huge help and I understand I have to do a medical exam.

We have decided to marry on 13th December and file I-485 and I-130 afterwards. My ESTA will expire on the 14th Jan so I would like us to submit the paperwork as soon after the wedding as possible. My question is would I be able to do my medical exam before the marriage so as to get ahead with everything I need to do or must the Medical be conducted after the marriage? I am conscious that there may be some delays in receiving our application due to the Christmas and New Year Holidays so I want to get our paperwork sent ASAP to give us enough time for our application to be received.

Any helpful thoughts would be appreciated :)

You can do the medical before or after the marriage, provided you submit it to USCIS within one year of it being performed.

Timeline

It doesn't matter whether you have your medical done before or after the marriage. I had my medical done a month before we got married. As Hypnos said the medical documents just have to be submitted within one year.

07 2003 - Met for first time (while in college).

08 2003 - Started dating.

05 2004 - Moved in together.

07 2007 - Got engaged.

06-26-2013 - DOMA declared unconstitutional. Finally.

08-15-2013 - Married.


08-19-2013 - AOS Package sent to Chicago Lockbox. (I-130, I-485, I-765, I-131)

08-21-2013 - Received by USCIS.

08-26-2013 - USCIS Acceptance Confirmation via email and text message for I-130, I-485, I-765 and I-131.

08-27-2013 - Checks cashed

08-28-2013 - 5 letters from USCIS in mailbox. I797C for I-130, I-485, I-765, I-131 and biometrics appointment notice (for 09-17-2013).

09-04-2013 - Early biometrics walk-in successful.

09-18-2013 - Online status of I-485 changed to "Testing and Interview".

10-24-2013 - EAD approved - card production ordered. AP approved.

11-01-2013 - Received Interview notice.

11-04-2013 - Received EAD card.

12-09-2013 - AOS Interview in Tampa. Approved on the spot. Card production ordered.

12-16-2013 - Received Green Card in mail.


09-18-2015 - Sent ROC Package to California Service Center.

09-21-2015 - NOA1 I-797

10-02-2015 - Received biometrics appointment notice

10-23-2015 - Biometrics appointment

04-04-2016 - Approved - Card/ Document Production
