Timeline

Hi everybody ! I'm currently at the beginning of my I-130 process. I received NOA1 about three weeks ago. However I like to think in advance and I'm a bit worried regarding the AOS. I am currently in Romania, as I am here with my wife, and don't want to leave to the US with her. I've been here for the last two years and I've been unemployed. In the last three years I only had one job in the US and gained somewhere between 7-8000 $.

My questions are:

1. do I need to submit the tax transcripts for the last three years?

2. how do I complete I-864 if I was unemployed?

3. do I need to write a cover letter to explain my case?

4. can anyone be my joint sponsor?

My friend was having an issue for sponsorship for her husband (she is disabled) and a friend of mine offered to do it. They had no family ties but his income was sufficient and it was accepted. Her husband has his green card now. I don't know how they will view your lack of a job, though; perhaps someone else has some input.

1) only the most recent year is needed. So if the AOS is due after April 15, 2014, you would need only 2013 taxes. (2012 if it happens before that.) However if you were unemployed you do not need to do taxes.

2) you do not need to submit anything if you were unemployed except a letter stating you were unemployed and thus not required to file taxes

3) yes see above

4) any US LPR or USC can be a joint sponsor as long as they meet or exceed the poverty guidelines for their family plus your wife.

Thank you for your reply. So being unemployed should not be a problem is that correct? I hope that they will take into consideration my age(23) and the fact that I only had 1 job until now is because of my age and not laziness ;)))). Any other advice regarding the i-130 process? Thanks !

My husband will be in the same position. He hasn't worked in 2/3 years. My husband is 27. We are hoping to have my savings (as i'm currently working), his savings and a joint sponsor (his step-mom)

As long as you have a joint sponsor you should be fine. Because you've lived abroad (and I assume didn't have a work visa in that country) or were in school is the reason you haven't had employment up until now. I don't think the NVC or consulate considers laziness or not when they okay an AOS. As long as someone is there to take the fall if your significant other uses means tested benefits they shouldn't have used, that's what they care about.

You may find people on the board have a more personal opinion than the consulate does. ;)
