Damn Constitution!

Separation of Powers prevents Obama from making laws. It would be easier if he were a dictator. The only way to change that part of the law is with new legislation which will repeal or redact or change wording of the current legislation. Obama can hem and haw all he wants...but that is the law of the land. Presidents have NO power to make or change legislation. This Act was so poorly crafted it did not even allow such things to regulations. The dumb@sses were in such a hurry to pass this legislation before the makeup of Congress (particualrly the Senate due to Kennedy's death) that they left out funding and didn't review the unintended consequences. This is because they spent two years trying to get DEMOCRATS to vote for it. They didn't need any Republican votes and never got any.

Now Obama has to go back to congress to fix his mess ups and now the Republicans control the House. Since it has been determined that this Act is a TAX, the legislation MUST originate in the Republican controlled House. Since the "electables", Democrats that need people to vote for them, also feel they have hoodwinked, there will likely be major changes passed by a veto proof margin.

The only thing "difficult" for Obama is trying to find a way to circumvent the constitution.

In case you haven't figured it out...Obamacare is history. Sebelius will jojn the ranks of the umemployed before Christmas.

If the Democrats had not had so much backbiting they could have prepared this legislation immediately after Obama's election, passed it in the weeks before his inaugeration and he could have signed it on inaugeration day. THAT would have been impressive. This is just another goat schtup!

Funny thing, though. President Obama has already amended the law without Congress, and anyone who tries to amend the law through Congress is racist, terrorist scum.

Actually he has not "amended" anything.

He granted 1 year waivers to big corporations that donate money to Democrats and granted 1 year waivers to Unions. The LAW allows these to be granted according to REGULATIONS developed by HHS. Obama DOES control HHS. Such as those granted to states which have their own plans or exchanges. The Republicans, if you recall, wanted to extend a 1 year waiver to everyone and Obama went to the extreme of closing statues and stuff in order to prevent that. Now he is trying to figure a way to do exactly the same thing he was willing to close statues for and give paid vacations to 800,000 non-essential workers (why do we have them if they are non-essential?) without it looking like exactly the same thing the Republicans asked for.

But that doesn't help the folks who will get canceled right before the election next year (brilliant plan that was) THAT requires a change to the law and THAT must be done by congress. This would require changing the law to eliminate the provision that you "can keep your insurance IF there are no changes to it after the law was enacted" It would also have to be changed to allow people to KEEP insurance they already have even if it does not provide for pregnancy coverage for males. A person could be allowed to sign a waiver that they are aware they have "inferior" insurance and choose to keep it. Both Democrats and Republicans are working on proposed amendments.

There is a lot wrong with the affordable health care act and a lot of it is down to the fact that Republicans refused to come to the table and discuss the issue like adults, they simply threw their toys out of the pram, stuck their fingers in their ears and screamed 'evil' for all they were worth. America health care sucks, it sucks bad and it needs to be overhauled. There is nothing about it to be proud of if you are an ordinary working American and yet the Republicans answer is to do nothing and tell people who have no access to regular health care to go suck eggs. That's not an answer, that's pathetic.

But the mess with the law that was passed is purely a Democrat fudgelump, as they had the opportunity to pass something exceptional, but lost their nerve, scrabbled to sell their votes for whatever they could get, and lost the opportunity.

As a result, America ended up with whatever legislation they could pass and not the legislation they should have passed. President Obama got his legacy, America is left to do the best it can from this missed opportunity. :(

I don't think they could have passed a bill that didn't continue the private insurance concept, it wasn't even on the table. It's hard to know if this is the best that could have been expected, but what is not in doubt is that IF the US legislative system was more inclusive than adversarial more could be achieved than is currently the case. What comes out of Washington is a picture of the administration stumbling from crisis to crisis. That is not healthy for America I can see why Americans detest the idea of government because what passes for government just doesn't work very well. The ironic thing is that the American people themselves defend the system (or at least the 'god given' constitution), just not the current incumbents, whoever they happen to be.

Whichever one isn't Democratic. The Republican Party knows everything and are always right about everything. There is no point in having a multi-party system or compromise. Every politician would be a Republican so they would win all the elections and rule as they saw fit. This is what would be best for the American people.

Indeed it is. It is a good idea to have a system that is held in check by having apposing points of view having a say, what is not so healthy is not ever sitting down to work out a compromise and that currently seems to be the position.
