Yup Another Travel while I-130 Pending Question

So I just booked my husbands ticket to visit. He is coming for two months starting at Thanksgiving to right after our one year anniversary! smile.png

We have been pending with our I-130 for six months now. I told him to make sure that he has his return ticket info with him when he lands. He works for his fathers mechanic shop and they will be writing a letter stating his work date of return.

Now as for money. We have about $2K in savings that we saved for spending while he is here. I wanted him to be able to have that info also so he can show he has no intention to try and work, but it's in our US bank account. Is that going to be a red flag? We have it in our joint US account so that he can use his US debit card and not get transaction fees.

That is all that we can think to bring with him since he has no utility bills or a house with his name on it as his parents own all that.

2 months is a bit of time, though i am not sure if he gets to go through border imigration within UK vs when landing... canada is a little different.

good you have a return ticket, just asnwer the questions truthfully. Though never tried for 2 months... usually been 4-5 days so please do let me know how that works out! very curious myself... UK is also on visa waiver program i believe?

The US bank account will not be a red flag, as you are married, and he is expected to immigrate at some point.

My wife and I had a 7 week VWP visit towards the end of our immigration journey, and the officer only asked to see a return ticket, and asked if we were planning to AOS or interview at the consulate. I was concerned before entering but it really was not a big deal.

No entry is guaranteed, but what he is doing is not at all uncommon. I do not see any red flags.

VWP travelers really aren't hassled very much. As long as he is honest, he does not have to volunteer any information either.

2 months is a bit of time, though i am not sure if he gets to go through border imigration within UK vs when landing... canada is a little different. Unless he has a stopover in Canada or Dublin (and Shannon?), Ireland, he will go through CBP in the US after landing.

Yes two months is a bit of time. He does qualify for the VWP so that won't be a big deal. He normally goes through immigration at his connecting stop, but his connecting stop this time is in Paris then landing in the US. So I bet it happens at his final destination, but I will keep you posted.

Thank you so much. I know it's not really different than his past visits. He got his ESTA in Feb 2012 and it expires Feb 2014 so he should be good. Thank you for the info.
