Getting DENIED because forgot to cancel returning ticket??????

Hello Visajourney members,

I have a really important question the story to it real quick:

This year I was flying to see my (at that time still) boyfriend in the usa!

We planned a round trip ticket from march 25th until april 7th 2013(I entered at poe with my two weeks stay)! While I was there we planned me staying longer so we booked a oneway returning ticket back on June 16th 2013! I was there only with my ESTA I didn't had a visa but I never came over the 90 days that you "can" stay in the usa with your ESTA.

The point is: We never cancelled the RETURNING flight on my first returning ticket!

I've been reading here that because of this people were getting denied when they were applying for their AOS when they came to the usa without cancelling their returning flight!

We are applying for a K1 and my question js could it be that we maybe never receive a NOA2 from the USCIS because of this?

09 August 2013 - Mailed I-129F

12 August 2013 - TSC receipt Date NOA1

18 August 2013 - NOA1 hardcopy received

09 October 2013 - Alien Registration Number changed

23 January 2014 - Orderd Service Request

05 February 2014 - Answer from USCIS: Can't tell you any timeframe when we will approve this petition

14 February 2014 - VISA APPROVED NOA2 after 6 months and 2 days goofy.gifheart.gifheart.gifheart.gifgoofy.gifdancin5hr.gif

21 February 2014 - NOA2 hardcopy received in Mail // USCIS shipped petition to NVC

24 February 2014 - Medical Appointment - passed the medical :-)

03 March 2014 - Case arrived at NVC

06 March 2014 - We got our Case # & Case left the NVC... Online Status says "In TRANSIT" :-)

10 March 2014 - Case arrived at the Consulate...

15 March 2014 - Received Packet 3 // Sent Packet 3 off same day

22 March 2014 - Received Packet 4 - Interview on March 28, 2014

28 March 2014 - Interview appointment RESULT: Approved :-)))

02 April 2014 - Visa On Hand! :-)

06 April 2014 - Finally being with my Love <3 :)

20 June 2014 - Marriage <3, Key West, Florida

USCIS has nothing to do with that. All they do is backgrounds check to the petitioner, check all papers that are sent in correctly. Since you already have your NOA-1 just wait until they approved your I-129F. You're now in 2 months for waiting. So you'll be fine.

Hi trisha, if i understand what your saying i did the same thing when i visited tisha, i bought a return ticket for 3 weeks stay there but i stayed for just under the 90 days and i never cancelled my return ticket and we bought a one way when i was returning back to ireland so that wouldnt matter as long as you didnt stay beyond the 90 days which you said you didnt

I think you misunderstood the other thread.. It says that the airline MIGHT forget to cancel your name off the airline name list and take as if you are flying..

I doubt you will have any issue with your petition! Be patient and good luck on your journey

13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

The issue comes with abandoning your AOS . If you leave without AP you have dropped your petition. They check to see if you leave. If the airline leaves you on the outbound passenger list you get tagged for leaving the US without AP or green card.

This will not be over quickly. You will not enjoy this.

What happens then, how does that get corrected?

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

You would have to prove that the airlines report is wrong by presenting sold proof that you didn't travel. Can be fixed but not without headache

I would be very surprised if this would be reason to get denied! I doubt USCIS will check your flight schedules ;) Don't worry, the extend of it might be that they will ask you for the date that you did leave the US to make sure you didn't overstay.
