Recommended Posts

Send the I-130 petition, along with two G-325A forms. One for the petitioner, and one for the beneficiary. Include proof of citizenship for the petitioner (can be a birth certificate if US-born, naturalization certificate or copy of all pages of US passport). Then, include as much evidence as you can of a bona fide marriage.

This package should be accompanied by a check or money order, as the USCIS will not even look at your papers without it.

Read it twice. It will take you one hour today, and save a lot of spousal separation.

i already read everything but i am scared that i make mistakes, so i want someone to tell me his experience and all documents he send and how...

You should have:

1. Cover letter.

2. Filled out and signed (by petitioner) I-130.

3. Filled out and signed G-325A - petitioner.

a. Attach (with paperclip) a passport photo, and write petitioner's name on the back.

4. Filled out (doesn't need to be signed) G-325A - beneficiary.

b. Attach (with paperclip) a passport photo, and write beneficiary's name on the back.

5. Copy of marriage certificate.

6. Copy of one of the following:

a. Petitioner's US birth certificate, or,

c. All pages of petitioner's US passport.

7. Copy of certificate of naturalization (if petitioner is naturalized)

8. Check or money order made out to Department of Homeland Security - USCIS in the amount of $420.

9. If either of you were married before, include court certified divorce papers.

10. If either of you were widowed before, include copy of former spouse's death certificate.

11. If you want email or sms notification of receipt, attach form G-1145 to the front of this package.

12. Evidence of bona fide marriage.

This may include pictures, joint assets, joint bank statements, flight itineraries and/or passport stamps to each others' countries, chat logs, phone bills showing calls to one another, receipts from things that you have done together, birth certificates if you have kids, adoption papers for a dog, you name it. Anything and everything that can help to show that you are in a bona fide marriage.

This entire package should be organized, for example in a manila folder, or however you best want to organize it, but don't use a hole puncher!

If the beneficiary is from a country in Africa or the Middle East, you should really focus on front loading as much evidence of bona fide as whatever possible.

You say you don't have a time... Wrong - you should have a lot of time, since you're ahead of some waiting and waiting and waiting... Time (and patience) is your friend in this process. The soon you understand this, your grip of the process will be better.
