Expedited Naturalization under 319 (b) of INA

Im going to be submiting our N-400 under 319(b). My husband is going to Korea and were have been authorized to travel with him. I have only been able to find a little bit of information regarding this option. So i will be posting our progress here to assist any one else that may be eligible for this option. Currently if have:

Cover letter requesting 319(b)

Copy of my PRC

Two Passport photos

Check for $680

Copy of husbands birth certificate and passport data/signature page

Copy of our marriage license/certificate

copy of my husbands divorce decree from prior marriage

copy of our childrens birth certificate

copy of our 2010, 2011, and 2012 tax return

copy of my birth certificate

copy of my filipino passport data page

Memo from my husbands company commander stating authorization for travel

DD1278 Certificaet of overseas assignment signed by my husbands company commander

Copy of my husbands military orders.

N400

I will be dropping my package in the mail within the next two weeks. Im only waiting to have the packet reviewed at the local USCIS on Fort Jackson and a few signatures.

I have also found a new form that i can submit to request the center i want my interview to be. ill be requesting fairfax, va since that seems to be the best place to handle 319(b) submissions. And they do same day oath. I have uploaded the form and in the instructions, it needs to be printed on blue paper. I found the form on the websited www.state.gov

Ok, so i dropped it in the mail today. My 3 year eligibility date isnt until August 2014. But because of use being on orders to korea, we can apply for citizenship under 319(b). I assume the eligibility date is the date we received orders. I mailed it to the Nebraska Service Center since thats where all Military N400 go. We requested in our cover letter and the blue paper that the Interview and oath be given at the Fairfax, VA Service Center. Its a 6 hour drive but worth it if we can get same day oath, and we will be close enough to our departure date that we can go to the near by Passport Service Center and get a same day passport.

The Washington Field Office rarely conducts same-day naturalization ceremonies but will do so for military N-400 filings, Section 319(b) N-400 filings, as well as on most N-400 re-examination days (second interview to pass the naturalization test).

Had a weird feeling about my packet today. So I called again and they told me the packet was mailed back to me on Friday because I was not within 45 days of deploying. She then put me on hold for about 5 minutes. When she got back on the line she said that she spoke with her supervisor and the supervisor said as soon as i recieve the packet to mail it back. It should not have been rejected. They have new people trying to get trained and it was rejected by someone not familiar with our 319(b) case. She said to put attention to the name of the supervisor. So this is a slight set back.......im pleased with how the lady handled the phone call but upset because the packet was handled this way by whoever rejected it...

Being resilient as i am, im gonna look at this as an opportunity to put the form G-1145 in the packet so we will recieve email and texts regarding changes in status to my form, and also put some more evidence just in case. I plan to send it back the same day i receive it.

That's sad how a trainee rejected your package without a supervisor or somebody making sure that what they were doing is right. I hope they do it right next time

Yeah. It is only a week set back. And i was told to address it directly to the supervisor, so this may help me packet get done faster. Maybe she will feel bad that it got sent back and handle all the background check stuff herself and send it to someone she knows will do the same at my requested field office in Fairfax. Thats me hoping lol. As long as everyhting is complete and we can get my wife a US Passport before we leave in march, i will be happy.

Just a quick question.. A person doesn't have to wait the two years to remove conditions if they otherwise qualify for the 319b, correct? They can go straight to the 319b once they get orders?

Yes, but the oath cant be done till within 45 days from date of travel overseas.

I still have not received my packet back. Im hoping it will be here today, i assume its taking so long because of Thankgiving. As long as we can have the interview and oath before february 19th we will be fine. I believe thats the cut off to give us enough time to apply for a Passport. If we were still in Colorado i wouldnt be to worried, i heard Denver does same day passports sometimes. But im not sure about here on the east coast...

I think most of the passport agencies do quick turnaround passports but I don't know which one is the closest to you. There's a extra fee for the expedited passport and you must make an appointment. Unless you of course apply on the day of your oath after the ceremony. Some people report very quick turnarounds for those applications.

Well its been 12 days since Nebraska said they mailed my packet back and it still hasnt gotten here! How long does mail take to get from the middle of the country! Im so upset its driving me crazy. every day i watch for the postman like a stalker only to be dissappointed. I would just mail another packet but i mailed it with money orders instead of checks like an idiot so now i cant do anything cause it takes 30 days to get a money order refunded. Everyday is a day lost towards getting my oath in time before my husband leaves overseas. All cause of some trainee mistakingly rejecting our packet....everytime i call its either they cant see where it was sent out or even received it at all or they cant get access to view how it was shipped. Dont get me wrong everyone ive talked to has been nice (except one time) and they wnat to hlep they just dont have access. Today i was told to call back first thing in the morning to speak with a person who has complete access to the entire system. Sigh....I just dont know what to do im freaking out

get out to your postal box, make certain your exact name is on the postal box.

Then meet your usps carrier today, tomorrow, all the rest of the week,

make certain they know your name and address.

Me and my wife filled under 319(b) back in Oct 2012 and finished in Jan 2013.

We did out interview in Honolulu as it is closer to Japan and they have experience in 319(b) cases as well.

Looks like most of the paper work you are sending is similar to what we sent. Slight variation since I'm DoD Civilian. One thing we sent that I do not see for you was fingerprint cards taken at the base here. Not sure if they are required but I sent them anyways since you can't report to a bio appointment as there is no USCIS office overseas.
