DS-260 questions

Hi guys -- I really did check the guides and the threads before asking this, so sorry if it's still a stupid one that should be self-evident :)

We're working on the DS-260 and have five questions:

  1. The requirement for a photocopy of "valid passport biographic data page" -- Is this just the first page of the passport with the picture and the date of birth and such? We just photocopy that and send that in?
  2. Photocopy requirement. USCIS says that photocopies are also needed in addition to the originals we send in.... but how many? Just one for each document requirement?
  3. Police certificate -- I see this listed in the required documents section, but is this just for someone who's got a police record or does everyone have to get one to show they're "clean"? How does one even go about doing that? For us, it would be a Canadian police record. I searched and found information about how to get fingerprinting done but that doesn't seem the same. I'm at a loss. Does everyone have to get one? What is "it" -- the certificate, I mean?
  4. Where he will work once he's in the U.S. -- heck if we know! I mean, we'll figure it out, of course, with all due speed, but what do people usually put here? Is it sufficient to simply state that he'll pursue a job in the field of his interest and state that field?
  5. Previous visits to the U.S. -- My husband used to come visit ALL the time! He didn't come on a visa. He just brought proof of ties to the border and went over. I'm not even sure we can cobble together every single time he's been over, though we could certainly try. We've been together nearly a decade, so we're talking a LOT of times.... Should we list them all to the best of our ability and memory??

Ohh, and one more question -- I'm probably overthinking this, but this question on the DS-260:

"Do you seek to enter the United States for the purpose of performing skilled or unskilled labor but have not yet been certified by the Secretary of Labor?"

My husband wants to come to the U.S. to be with me. Yes, he wants to work. No, he does not have a job lined up.

How do we answer that question?

  • It is the first page with picture and the page on the back which has parents or spouse name and address. Usually those two page has information about the passport holder such as Issue date, Expire date, Passport number, Name of passport holder, Address of passport holder, parents/ spouse name of passport holder.
  1. Photocopy requirement. USCIS says that photocopies are also needed in addition to the originals we send in.... but how many? Just one for each document requirement?
  • One photocopy for each document is good.
  1. Police certificate -- I see this listed in the required documents section, but is this just for someone who's got a police record or does everyone have to get one to show they're "clean"? How does one even go about doing that? For us, it would be a Canadian police record. I searched and found information about how to get fingerprinting done but that doesn't seem the same. I'm at a loss. Does everyone have to get one? What is "it" -- the certificate, I mean?
  • Everyone has to get one from the city or town whereever they lived since age 16. I am not hundred percent sure about how it is in Canada. My answer might be not correct in case of Canada.
  1. Where he will work once he's in the U.S. -- heck if we know! I mean, we'll figure it out, of course, with all due speed, but what do people usually put here? Is it sufficient to simply state that he'll pursue a job in the field of his interest and state that field?
  • Yes the field he will pursue his job.
  1. Previous visits to the U.S. -- My husband used to come visit ALL the time! He didn't come on a visa. He just brought proof of ties to the border and went over. I'm not even sure we can cobble together every single time he's been over, though we could certainly try. We've been together nearly a decade, so we're talking a LOT of times.... Should we list them all to the best of our ability and memory??
  • Should list them all. If necessary add an extra paper. Just in case.

Im not sure if you DS 260 is different to mine but on mine it said:

What profession does he intend to work in, not WHERE will he work!

It also only asks for the last 5 visits to the US above the actual question.

I put NO to the question of do you seek to enter to work skilled or unskilled. I am NOT entering for that reason, i will get a skilled or unskilled position after entering but that is not the reason i'm entering.

1. Yes, that is the biographic data page

2. Photo copies are for your own records as well as you should have a copy to give them at the interview. So 2 sets of copies. Since you are filing the DS-260 electronically, you should have a hard copy of everything you submitted electronically to give to them at the interview as well as the original documents such as the marriage license, birth certificate etc.for them to review.

3. Everyone needs to get a police check - if there is no criminal background he can just go down to a local station and request a CPIC, For my husband it only took a couple of days and was free. When you request it, just let them know it is for immigration purposes and they will make sure to fill it out correctly. The advice we got from an immigration lawyer is to just list things to the best of your ability - obviously you want to show your intent to be thorough and forthcoming with whatever information has been requested. We have a similar concern in regards to places my husband has lived...there has been a lot since he was 16!

Two more questions -- Under the last question regarding a preparer of the form -- My husband supplied me all the info but I've been filling it out for him. Should I put myself down as the preparer? Does that hurt us at all? If so, I'll exit out and let him redo this whole blasted thing! :)

Lastly, how do we submit the requisite documentation? Do we send it separately with the barcode IV cover letter, after we e-submit the DS-260? In the screenshots, there doesn't appear to be a page where you upload e-versions of the documents, which is why I ask.

You are really need to study this wiki... Canada is eligible for electronic processing so that you can email a PDF containing all the information. But you need to OPTIN and have it accepted before you can email anything.

DS-260 is different than the DS-230. You will need the exact address for every place he's lived for any period of time since age 16. You will only need the last 5 visits to the USA.

btw I moved 18 times since I was 16 (now 19 including the move to the USA) with 13 different (now 14... lol) addresses. Yes I had to put all of them down.

DS-260 is different than the DS-230. You will need the exact address for every place he's lived for any period of time since age 16. You will only need the last 5 visits to the USA.

Actually the DS-260 has changed and does not require exact dates for all the places that the beneficiary has lived since the age of 16. Just month and year. Exact dates are still required for employment and education history. I completed the form a few days ago.

Another thing is about the OPTIN. My spoused and I called NVC several times this week to inquire about whether they have received the OPTIN email and when can we expect the confirmation so that we can start emailing them the AOS and IV packages to them.

The rep we spoke with on the phone told us that we did not have to wait for the confirmation/acceptance email and told us to email the packages as soon as both the AOS and IV fees are posted as 'PAID' and completed the DS-260.

We were weary of the answer at first and tried calling back a couple more times but got similar answer.

Can we get a confirmation/clarification on this info? They seem to be constantly changing/updating the process and it might be true that they have eliminated that waiting period for the acceptance email.

POE - Jan 25th

Update on GC and SSN

(as of March 14th, 2014)

ELIS status - Closed (Card produced)

USCIS case check with receipt number (starts with IOE) - Card delivered in the mail

I said nothing about exact dates.. I said exact addresses... you still give them month/year but they do not qualify it like the DS-230 with anything over 6 months... so that means to me at least, any place you have lived for any period of time, since the age of 16.

Sorry about that. I was fixated on dates after filing up the long DS-260.

You are right. All residential addresses since the age of 16 regardless of the length of stay.
