I have filed i130, i485 and i765 concurrently for my husband whom I married 4 years ago. I am a US Citizen and I don't have a joint sponsor. I have received 2 Request of initial evidence letters. one asking to submit tax return and the other one asking for evidence of assets. I was out of country last year and earned foreign income, and I have just late filed my 2012 tax return. I have filed the tax form 2555, Foreign Earned Income Exclusion, so basically my income on tax return last year was zero. I have savings from a foreign property which I sold three months ago. I have transferred the money into my US savings account and the amount is slightly above the 125% poverty line of a family of 4. I have evidence of ownership of my foreign property (on my name only), showing the date and value that I acquired the property and the date and value that I sold the property. I also have bank statement showing that the money from the property is deposited to our foreign joint account, and then wire transferred to my US bank account (my name). But my bank account was opened 2 months ago, I was not able to show the 12 months statement. Does it really matter?


I have also opened a s corp in July 2013 and currently being hired as a subcontractor for $2000 a month with a two year contract. I have a subcontractor agreement with the company whom I provided the service. I had not included this in my previous i-864 which I submitted earlier, so I am going submit a new i-864 along with the new evidence. I believe I am now considered as self-employed, right? Since I have just started my job/company, I cannot provide any tax returns,1099 or schedule C which is required by USCIS. Will USCIS still count this income towards the 125%?


Please help!
