we dont know how long they knew each other before they did k-1 visa....then only 6 months of marriage.......we aren't attorneys here but if i was in his shoes i would hire a good immigration attorney......

im helping a friend . and i told him that i have a great site where i can possibly ask for opinions and suggestions on what to do. so heres my friends situation.

my friend is a beneficiary from k1. everythign went well, he was able to go to the US, and got married, applied for aos and got his green card after three months. hes working as a nurse and fell in love with another nurse. he is only 6 months in the US ( i know hes stupid, ive told him already so many times) yet he managed to cheat and fell in love with another girl. ,. these are his questions.

can he file for a divorce to his wife even if hes on a 2year green card?

if so, can he marries the new girl after the divorce?

- does he needs to go back to the philippines after divorce and apply another k1? or can he stay with his new girl and adjust status? please help. i have no idea what on earth to tell him. we are so close so all of yall out there who wans to punch him, i want to do the same thing. but hes firm with his decision that he doesnt feel love anymore with his wife, ( his wife's work entails travelling alot, so most of the time according to him hes left alone). could be true but could be an alibi. anyhow, can you all experts help my friend? please let me know what moves he can take. he wants to stay in the us with his new girl. his new girl is a USC, american to be exact.

Sorry, this is how I feel about the situation.

It's possible, depending on your wife's conduct..

I feel like it is impossible, yet possible. That's why some people really need to make the right decisions first before jumping into this kind of matter.

It really does depend on one another's conduct. If there are certain things that she wants to do things in the house, that the husband does not like, or vice versa.. that starts an issue. If they don't talk about it, then it burst out like a wildfire from then on.

That's why I really feel like, couples should live together first so that they could see how they do things or how they behave inside the house. That's case-to-case basis though, but I think that would help.

My boyfriend and I did. What sucks is, we can't even get the K1. Lol! Oh WELLLLLLLLL..

i cannot certainly answer that... i guess the point here that I want to clarify is this:

1. my friend does not intent to stay in the US illegally if he will have no legal options, by that, i would not be posting a topic which i know will be hotlisted. I was plainly asking for opinions and advices on how he should go about given the scenario.

2. if someone would advice to grab an immigration lawyer, then il tell him to get one., this isnt an issue of my friend wealth, or his family wealth. as ive written in my precious post, this visa he got is not the only visa he got prior to this. he was travelling back and forth from US to phil. my fried for all i know has no plans on evading immigration law as it will totally affect him and his father who is a high ranking official in our country.

I AM ONLY ASKING FOR ADVICE ON HOW TO GO ABOUT ON THIS LEGAL MATTER AND NOT JUDGE MY FRIENDS WEALTH, OR HES ACTIONS. I KNOW HES A STUPID GUY. TWO THUMBS UP FOR THAT. He can apply to remove conditions on the green card after the divorce. He will need to prove he entered the marriage in good faith, and not with the intent to evade immigration laws. As he has the resources, hiring a good immigration attorney would be in his best interest. It would not be in his best interest to get married or engaged before conditions are removed on the 2 year green card. It would not be in his best interest if its a contested divorce fighting over who's fault it is.

His spouse should file for the divorce. This might partly affect how USCIS views his adjustment of status petition after the divorce, but even more important to his marriage status back in the Philippines. He cannot get that divorce recognized if he files for the divorce, he must be the respondent in any divorce. If she were a Filipino citizen, then there is no way to get the divorce recognized in the Philippines.

The point is marriages fail, even when immigration is involved. USCIS knows this. I'm sure it didn't help the situation that she was out of town 5 days out of the week. Many people go through divorces after coming on K-1 visas and remove conditions on their own. I'm sure he can to. Proving cohabiting, and mixing of finances seem to be the most important items that USCIS looks for in these cases. They don't even really seem to care if cheating was involved, as looking for that isn't really written into the laws they have to follow, unless the cheating was by the immigrant and began before the wedding. If his ROC application does fail, he can always return to the Philippines to try again, as long as he can get the divorce recognized there so the CFO will give him a sticker again.

so, there is recent development on this post, few minutes ago, i called my friend after i i sent a snapshot of all ur comments. which i think he deserves to know . i was able to talk to his wife as well and spent on the phone for the last 45 minutes. so heres the real situation according to both parties. the post i wrote was my friends side, and this is the wify's side. interestingly, my friend doesnt need to ask the wife for a divorce because his wife too is cheating (#######) and as i am writing this post, they are actually together right now and i dont know what on earth they are talking, but an hour ago, i talked to them both. so here it is,

wife's job entails alot of travel, she only spend 2 days in their house and from mon-fri she travels and wont get home until saturday morning. all this time, i, and my friend thought that hes the only one cheating. but her wife confided that she too was and is still dating someone despite the fact that they are both #######, i mean married. now that they are confronting each others mistakes, both of them admits that they have cheated on each other ( they are totally #######) and that they fall out of love (just like that) . and now, they want to separate ways and wife wants to file a divorce so she can be free and for whatever reason, probably marries another ####.. i mean man. ...

given the scenario, if they both agreed to a divorce because both of them are #######, i mean cheaters. can my friend after the divorce, and on his ROC do it on is own if its the USC who will initiate the divorce? to be honest, i am totally confuse and shock and anxious and furious and name whatever u feel when someone tells u that they both cheated on each other and here i am, wide awake in the morning (its 4am) in the philippines. trying to help them out when in fact, both of them should suffer.. sigh.. but anyhow, sticking to the facts of this post, what are my friends options?

First of all, I have no idea why you are even getting involved. Let them both hang themselves. Its not your problem.

Second, does the wife know that divorce does not release her obligation to her husband? meaning, Married or divorced, she signed papers to be his sponsor. Unitl he becomes a citizen, she is still "responsible" She should really read up. I'd send his cheating a$$ back to where ever the Fug he came from. That is just too much drama for my taste. Get out from under that lead weight on her shoulders. Turn his a$$ in to immigration and let him get deported.

It all sounds so fishy to me.

Do yourself a favor and walk away. Tell them you have no idea and leave it like that.

If your "friend" is a real man, then he should come clean to his wife and declare his love for someone else and his desire to divorce her. Three months before the end of his conditional residence's expiration he should apply to remove conditions declaring that his marriage was entered in good faith.

On the other hand, he may continue to cheat on his wife and carry on with the co-worker nurse for a while, perhaps until the time to remove conditions on his residence comes and he could let his wife file for him.

I feel so bad for the wife. All the heartache and effort she made to bring him here and this is how he thanks her...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

my friend is 27(male). and his wife is 29 (i think or 30, imnot sure as shes not my wife lol). i dont beleive that my friend entered the marriage by fraud because if it was fraud, they (his family) would not spend a million bucks to come visit USA to attend their wedding. all of his brothers and sisters (5 in total) and his parents flew to the US to witness the wedding, they all have multiple entry b2 visa. (including my friend and my friend's family here in the philippines is somewhat famous as he is a son of a senator in the philippines. ( i shouldnt be posting this info .. lol...the senator thing ). in my honest opinion, i think the marriage was entered in good faith, but i also belive that my friend is a ####### and sometimes, he decides with impulsiveness. now that hes having a problem, he now turns to me because thats what friends are for lol. and since i was able to find this site, i might as well take advantage of the informations this website has to offer.

OP, you do realize that you've practically outed your friend and his dad. All any of us here who are Philippine-born need to do is post a series of questions on Facebook and we can find out who they are and who you are. Many of us are top professionals who paid our taxes in the Philippines and are sick of spoiled political families who think they are above the law. Your "friend's" marriage sounds like a fraud. Your "friend" sounds like a spoiled #######. I don't understand why you are helping him...Or maybe you aren't? The road to hell is indeed paved with good intentions.
