need help regarding immigrant visa, my father is the principal applicant petitioned by his sister, our priority date is 30/04/90, we received a letter last 23/11/2010 that we can process our case, so my father, mother and me (daughter) got a processing fee bill invoice, we were wondering why im still included for visa processing since im already 25 yrs old by the time the letter came out, we thought maybe coz of the cspa, so we paid the processing fee then we passed the required documents etc. The last time we inquire nvc, our file has been placed on the list of documentarily qualified cases awaiting for availability of visa number but since we were affected by the retrogression, our priority date will be current by december 2013, last oct. 2013 we got an interview letter appointment which is scheduled Dec. 2013, problem is I am not included in the list of applicants eligible for interview. Now we were wondering why im not included since I paid the fee and completed the documents needed to be submitted. Does this somehow related to CSPA, did i become not eligible by this year? even if my case was qualified before.

we beed some key dates, your birth date, your priority date, and the date the petition was approved.

DOB: 09/28/86, Case Priority Date: 04/30/90, Approval Date: 11/24/2010 not sure about this one, this is the date we received the fee invoice, we completed the requirements i think around march/april 2011.

this is the reply i got from NVC...

According to our records, the principal applicant's child is now 21 years of age or older. Consequently, the child is no longer eligible to be a derivative applicant on this petition. Upon entering the US, the principal applicant may file a separate immigrant visa petition with the Department of Homeland Security's Office of U.S. Citizenship and Immigration Services (USCIS) on behalf of their son or daughter.

There is a law, however, the Child Status Protection Act (CSPA), which applies to a narrow range of cases that may allow the principal applicant's son or daughter to remain eligible under this petition. At the time of the parent's visa interview, the consular officer will determine whether or not CSPA is applicable in this particular situation.

so i have to wait til my parent's interview to know.. :C

You only have a years time to seek a green card under CSPA. So your time might be running out. Find out when your petition was approved. Call USCIS. Get active, or you might need another 7-20 years to immigrate to the US.

It's amazing how many questions can be resolved with a 2 minute Google search...
