Hi,

I am currently having H1B visa and just got married. My husband and I are planning to apply for my green card through marriage.

However, he previously was married and petitioned for his ex in 2006. His marriage didn't go smoothly and they filed for a divorced in 2008, and got it finalized in 2009.

He thought she might have used him to get a green card.

Now if he applies for a green card for me, would his previous petition cause a problem for my application?

We dated for 3 years and have been living together for almost 2 years before we got married.

Please advise! Thank you in advance!

It might cause them to take a closer than normal look at your case, but provided you have a bona fide marriage (and more importantly can prove it) then you should be fine.
