Our lawyer sent me an email telling me to go ahead and schedule my K-1 Interview appointment with the embassy------BEFORE the NVC even had received the case from USCIS California Service Center. I did not know this at the time, so I went ahead and scheduled the interview for 13 December at Vancouver even though I am a Toronto resident bc the interview date is much earlier & fits better with our plans.

I talked to the NVC today and they JUST NOW GOT THE CASE TODAY! I tried telling the agent and supervisor at the NVC that I wanted them to send the case to Vancouver instead of Montreal, but she was no help and insisted that the request needed to be made by email, and then acknowleged that chances are there is no way the email will be read before they send the case to Montreal. She suggested that I wait until I have an email confirmation from them saying that the case has been sent to Montreal & then at that point I should email the Vancouver Embassy and ask them to request that Montreal transfer the case to them. Does that sound right? Anyone with any experience as to whether the Montreal Embassy will cooperate in sending the case to Vancouver so I can do my interview on 13 Dec at Vancouver?

I am not sure why the NVC can't just send it to Vancouver as I requested....#######?!

Sorry It's not likely going to happen. Where your interview takes place for the K-1 depends on where you live. Not only do you need Montreal to cooperate you need Vancouver willing to accept it also.

You will many lawyers are not that familiar with how things run in Canada, as they don't have many USA/Cdn clients! For people that are on VJ and have lawyers--I highly recommend you goto the appropriate forum and read the GUIDES, as no 1 care more about ur situation, than you!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

If everyone was allowed to schedule interviews at Vancouver because the interviews were earlier, then we all would :(. Unfortunately I have never heard of anyone being able to do this or I wouldof. Your lawyer is clueless to have told you to do that. Hope things work out for you.

I would inquire with the NVC and with the Vancouver and Montreal consulates if the fee could be transferred or if you still have pay it again.

Just to echo what others have said- lawyers are useless for Canadian K1s and IR1/CR1s 99% of the time. Sorry your lawyer gave you bad advice. sad.png I would recommend ditching the lawyer and doing research here on visajourney. Your lawyer doesn't seem to know what's going on as all east coast K1s and all CR1/IR1s go through montreal and you're also not supposed to schedule an interview until the montreal logs your packet 4, which is usually somewhere around 4-8 weeks after NVC receives your case...

US immigration runs by its own rules and seldom if ever deviates. As previously noted, they don't make exceptions for people who just 'want their interview at the faster consulate. We'd all have wanted that.

I would let your Lawyer go and complete the rest yourself. The lawyer cannot make the process faster for you, he/she doesn;t have special priviledges to make the process faster. They are just making money off you. It's like having a lawyer do your grocery shopping - sure he can do it, but his results aren;t going to be any different than your own.

Also, anyone correct if I am wrong, but you are not suppose to schedule interview before receiving P4, and if you do then the interview usually gets cancelled. That's what it says on the P3 sheet. OP I am sorry that your lawyer informed you of the incorrect time to schedule the interview. I hope everything works out quickly for you in Montreal and you get a reasonably soon interview date. As others have posted, most likely Montreal will not transfer you case to Vancouver as you are in Montreal's district sort of speak.

If your lawyer doesn't knock down his fees for giving you bad information or if you want to make a complaint, you can contact the law society of upper Canada. I believe that's the Ontario one, it's morning on a Saturday and I confess. I'm pre caffeine and have a dog on me lol. If your lawyer doesn't work with you to fix this bad, the law society is what oversees the lawyers. Believe me, they do take complaints seriously. (And yes. I work with lawyers here in ab, and I've worked with some that have run afoul of the law society.)

You won't get transferred to Vancouver unfortunately. And as mentioned by on-vt up there, you can't book until you get your packet 4 (send in all your packet 3 stuff)

Of the packet three the thing that takes a while is the police check - go check out the RCMP/OPP detachments or comissionaires to get this done. Can take up to a month sometimes.

Also for the medical (which you also can't do until packet 4) if you have your vaccine history, awesome. If not, you can request a blood test from your doctor to see what shots you need. Some of the boosters need multiples over a time period, so check that sooner rather than later.
