If you leave together he will almost certainly get denied based on what I've read. Your best bet would be to go ahead and have him join you at a separate time. Their usual problem with I-130s is that if you don't have your NOA2 yet, you may get rejected while in the US and decide to stay.. but if you are past that you have a better chance.. with a set interview date, you're pretty much good. Just make sure he has a lot of proof that he'll return to AU.

I hope this is a forbearance for everyone here in the November thread, but 10 minutes ago I just received an email that said USCIS has approved! I'm in shock but obviously thrilled.

I know many have seen the standard email, but I ill post mine below in case others want to see the specifics.

Yes. This was TSC. It's a miracle of sorts given so many unapproved October petitions. But I'm grateful of course. I am hopeful this bodes well for everyone here. We were not an expedite and there is nothing special about our petition so I'm thinking that TSC may be re-awakening. Let's hope!

I don't want to be melodramatic.. But hypothetically if my therapist wrote a letter saying I'm in bad mental health and so is hubby is there any chance of expedite? Clearly I'm now losing it for real.

I doubt they would tbh. Hang in there, won't be long. I had a crack but my mind wasn't on it, my wife is getting here for 2 weeks tomorrow. Perhaps if we all write something then get the salient points and pull it together we could have something strong enough by next week?

Oh yes, I'm leaving Friday May 16 to see her for a couple of weeks. I'll be there for her birthday and had been hoping to surprise her with an approval. Instead I spent an hour on Skype last night trying to dry tears from 6000 miles away. First it took me a year and a half to get a completely uncontested and totally agreed upon divorce finalized. I met my current wife about a year before the divorce was finished. Well you can't even petition for a fiance visa if you're technically still married. So this entire process began about 6 months later than we wanted. But the entire time I've been going there for 2 or 3 week visits about every 2.5 to 3.5 months. The financial drain is now coming to a point where I think this may be my last trip that is planned in advance. I would hate to be there in August only to find out that I would need to stay an extra two weeks unexpectedly or have come back again in a couple of weeks to be there for the interview. Post NOA1 to visa in hand for Romania seems to be around 3 months if past timelines here are anything to go by.

Man I totally get your situation. I filed for D in July '12 and took over a year to get it through the system while she waited patiently. We met while I was separated, so I've spent ungodly amount of money on flights already.
