I've done a very loose draft. I'm trying to get my flat tidy because the missus is arriving Saturday for two weeks :) All comments and suggestions welcome. I've tried not to sound too angry at this stage but that's just me. Let's see if we can come up with something more definitive that covers all issues:

Dear

I am a November 2013 i-130 filer for a CR1/IR1 visa and I am shocked at the wait times at USCIS. After promising to get times down to 5 months by May 2014, they worked fast to try and approve this goal but there has been a severe slow down in processing applications. Many filers who are over the 6 month mark are being informed they cannot yet file service requests because they are still within normal processing times.

A representative sample from the Visa Journey website reveals that CSC approved no December 2013 or February 2014 applications but has completed January and is working on March and April. NBC is less than halfway through November while TSC have approved less than 50% since September 2013. Although they do appear to be actively working on April 2014. VSC, on average, are approving less than 50% each month but have approved more applications in January 2014 than August 2013.

The only conclusion that can be drawn here is that USCIS are manipulating the figures at the expense of earlier filers. I was under the impression that applications were looked at in order of priority date. How can people plan for the future when they have no idea when, what is after all only the start of a long process, their i-130s will be approved? Is it fair that some people could be waiting 9 months while others wait as little as a month for no other reason than USCIS needs to show stakeholders it has cut the wait time?

I know you understand that this is a very painful process as we are separated from loved ones for months on end. For those with children it is exceptionally hard. I am bringing this to your attention because I feel so powerless in this situation, which is not aided by the fact that information from USCIS on the processing time frame varies from one call to the next.

I would appreciate your assistance in any way possible to urge USCIS to adjudicate cases on a first come, first served basis and to recognise the pain and stress (emotionally and financially) that i-103 filers feel on a daily basis.

So out of sheer aggravation I put in a service request saying that I got approved and never received my notice. I only did this because they won't let me put in a request so early. So I got an email saying:

Recently, you or your representative contacted USCIS concerning your case to notify us you never received an approval notice. Below is a summary of what we found and how the issue has been or may be resolved.

Your case is currently pending and will be worked in the date order that it received and that is the reason you have not received an approval notice up to this time. However, your case is currently being reviewed by an adjudicator and you should be receiving correspondence about your case shortly. NOTE: Please be sure you are registered to receive mail at the address listed on your petition. Your name must be physically placed on the mailbox. Keep the U.S. Postal service informed as to who resides at your address, especially when people with different last names receive mail at a specified address. This and failure to submit address changes are the two main reasons mail is returned to us as undeliverable.

It didn't say. The email said exactly what you would see on the website. Something was mailed out, follow the instructions, blah, blah blah. I'm going to be 45 in August. My wife and I would like to have at least one child. Needless to say I would rather not be going to a high school graduation with a Hov-a-round scooter. This has already taken too long, way too long. Particularly when the number of people who qualify for expedited processing seem to outnumber those who don't. This is one of those times, and those times are growing much more frequent, when my patriotism and love of country are seriously put to the test.

I see, is there any way you can even visit your wife until this is all over? I truly feel for you and everyone else!

I really need your guys' advice. I'm at my wits end. Here's the thing :

I'm abroad with hubby in Australia

I've been here since July 2013 and my visa here expires this July 2014

I really want to go home but don't want to be separated

What do you think about us going home next month TOGETHER to US with return tickets to Australia? We could spend three months in US then come back to AU for his interview (I can get a tourist visa when this one expires).

Do any of you have spouses visiting the US? How is boarder control? Have any of you gotten sent back on arrival?

I know this is expensive but I've had it. I don't care about money.

I'm terrified that we will get to US with proof of pending I-130 and return tix and they still turn us down and send him back.

Help please!!!

It's totally possible they would turn her back. I would. You can try though. Be prepared to buy her a ticket back the same day you land, they make you pay for it. There are no guarantees.

If you leave together he will almost certainly get denied based on what I've read. Your best bet would be to go ahead and have him join you at a separate time. Their usual problem with I-130s is that if you don't have your NOA2 yet, you may get rejected while in the US and decide to stay.. but if you are past that you have a better chance.. with a set interview date, you're pretty much good. Just make sure he has a lot of proof that he'll return to AU.
