Maybe I should try to apply for K-3 in the mean time...

I have learned that it is possible to visit the US while a visa is pending. I went to the US Consulate to have my son's birth recorded abroad and I asked the diplomat this question. He told me it is strictly the discretion at border control upon entering if they let you enter or not. That being said, she would need strong ties to demonstrate she is going back to Taiwan. Lease/Mortgage arrangements, Employer letter, etc.

I was told that the USCIS is separate from Border Control.

I also asked about the K3. he told me it is useless to file K3 as it takes just as long as it would your visa and sometimes the visa gets processed quicker.

Hope this helps.

We applied in October, and are also hoping they speed things up.

Most of Canada is serviced through Montreal. I think it's really just Alberta and BC that go through Vancouver. With any luck, this means that our post I 130 processing will go fast, due to Vancouver processing fewer applications!

Wah, Well, found out today that Vancouver consulate ONLY processes K1 and K3 visas, all others go to Montreal. Ridiculous. I guess I'll have to factor in the expense of having to fly to the other side of my country to do the interview. Hopefully hubby and I might make a romantic few days out of it!! But really, how silly. I suppose it's all about cut backs.

Sigh..........................

When I went to the US to get married in September, I had employment verification letters, letters from my bosses confirming I was coming back to work, a return ticket and utility bills from where I live, to confirm I was returning to Canada. The border guard was stern but nice, and told to me to make sure to have these very kind of documents when I go to visit my husband in the interim. "Proof of ties and equities in Canada', he said. I managed to make him laugh (very slightly) when I said I only had debt, no equities......He didn't ask to see any of the documents I had, as I think he knew I was being honest and could produce them if he had wanted to see them. I've yet to experience any unpleasantness at the border, and I've been travelling back and forth to see my hubby for over 5 years.

Hi everyone - quick update on my case - we still haven't received our hard copy of NOA1 (it's been 23 days since emial - 18 working days)

Gave USCIS a call today to see where it is and they said if it hasn't arrived then it most likely got lost in mail! :( and that they don't do duplicates.. So, there goes that.

I also asked about wait times and the guy said Nebraska has just finished Feb 2013 i-130 filers and that our wait time is approx 10 months!

Oh well... more waiting around..

Good luck everyone.

Another November filer here, NOA1 date of November 25, also going through Vermont.
I'm just ecstatic that we can finally file, after getting my daughter's fathers permission. It's been a long 9 year wait, dwarfing anything the USCIS is likely to throw at us (I didn't just jinx it, did I?).
Guess it's never too early to polish up the affidavit of support, even if we'll need 2013 years tax return =D

OK, the USCIS drone gave you some BS. Did you talk to a Tier 2? Never trust anything the Tier 1's say, a trained monkey could give you better info.

FYI, we filed the same day and the EXACT same thing happened to me. I never got my NOA1 but I did get the email. I called and put in a service request with a Tier 2 to verify that it was issued as some point. I have confirmed, repeatedly, that it is at the VT service center, and not lost in space. You can do the same thing I did, put in a service request asking for it and they will send you a little letter on USCIS letter head stating your case number and informing you that they don't make copies (a lie, they actually do, but only for completed cases). Relax, trust me if there is a case # they have it.

I'm assuming I spoke to a tier one - it sounded like he was reading from a script, If I get a chance tomorrow or Friday I'll call again and ask for a tier 2, Do i just try get hold of an actual representive and ask them? Oh and do you know which buttons to press to get to someone without listening to all the pre recorded stuff? that gets reallly annoying. lol

I just don't want them to send stuff and not receive it as they could send an RFE and it could get lost or something.. it really worries me

Just keep pressing 1 until it asks for a case number, then press 3 or say "I don't have one." Then when the tier 1 drone comes on demand to speak to a Tier 2 in order to make a service request. If the Tier 2 gives you any sh!t about not getting your NOA1 demand to talk to a supervisor.

That is an estimate based on an algorithim VJ spits out using other filers' data. It fluctuates a lot. I would not count on anything be March 25th if I were you guys.
