Hey Everyone. I had a question about a file. My father and mother are green card holders. They recently filed a I-130 for my brother who is currently in India. He is 26 years old and is unmarried so we filed for him awhile back. When we filed the i-130, we included a letter stating the hardships he would endure if he were not able to come to the US earlier. This is true because me and my sisters are in the US already and he is the only one that is left in India.

Well today, My parents received a I-797 letter of approval for the I130. In the letter it is saying that my brother should receive what to do next within 30 days. Well initially when I spoke with a few people and did my research, people were saying that it could take up to 8 to 10 years for his visas to be approved. Does this letter mean that the application was expedited? Or does this mean that it could still take a really long time? Any help would be really appreciated. We really want him to come here as soon as possible . Thank you for reading this long post.

Hi Sapna,

You should have get first I797C than you should get I797. The 2nd I797 notice means it as approve, he should get a mail from uscis. Are your parents us citizens? if they are then she should be here with in 1 year. if your parents are green card holder than he will have to wait for 5 years. ###### luck

hi,

not true.

it doesn't matter how long it takes for the i130 to be approved, he still has to wait until his priority date becomes current. You don't mention when was the i130 filed, depending on that will be the years that he still has to wait. the approved i130 will be sent to the NVC or National Visa Center, they will contact your parents and send a letter with a case number. that's it for now until his priority date becomes current in years.

he now has to check every month the visa bulletin to see more or less when he will be able to come, the second part of the process with more payments, forms and documents to be sent will be when his priority date becomes current.

Wow, thank you all for the quick responses.

My parents are both Green Card holders. I have not received a I797C. Just a I-797 with an approval letter. I really thought that they expedited the I-130 but I guess they did not. Sucks, Had my hopes up for a second. But we filed for him about 6 months ago. Again, thank you all for the responses and help!

what they did was expedite the i130, which can take years to be approved. but that doesn't change the amount of years he still has to wait.

the i130 can take 6 months or 3 years, that doesn't mean anything. he still has to wait in line, there are many like him who are waiing to be with their families.
