I'm a J-1 holder, currently working in the US as an intern. Me and my fiance want to get married before my J-1visa expires. First of all, am I able to quit my internship and move to another state to live with my fiance and get a legal work permit? Should we wait until after we get married and apply for K3 or go straight for the K1? Do I follow the normal marriage visa procedure or is there anything special we have to do due to the current J1 status? I havent found any info on working visa(work permit), what is the best route to get quick residence and working status?

Sorry for the all the random questions. We've been looking and still had these questions so we thought we'd post 'em up here. Thank you so much for taking time to help me out!

You wouldn't need to apply for a visa, you simply need to adjust your status. This process is started by concurrently filing forms I-130 and I-485 after you receive your marriage certificate.

Our journey:

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If you get married there is no point for the fiance visa.... you would just file for adjustment of status I130, I485, I765 and I131 (last two are optional but highly recommended)..... you would need to wait for your work permit to arrive while your green card is in process in order for you to be able to work.... Maybe there´s another VJer that can provide insight in regards to the J1-AOS-GC holder status in your case, but you would just fill out the forms I mentioned and make sure you follow and submit all the evidence and documentation that is required.... of course, all of this after getting married... good luck!

I had a J1 and was told you need to have that job and that job only for the current visa to be valid, otherwise you would have to go home as you would be out of status. You can't move to another state and apply for a work permit, without adjusting status. And you can't adjust status without getting married. I'm sure others can explain things better.

Providing there is no 2 Year Home Residency Requirement, you would be able to marry and file the forms for AOS. Applying for a K1 would mean having to leave at the end of your programme.

A friend of mine is considering marrying at the end of her programme during the month you get as just a tourist, and filing the forms then. That way she can save up money until the last possible moment (as you won't be able to work as your AOS forms are processed).

09/04/14 - EAD Card Approved!

09/11/14 - EAD Card Received

02/27/15 - Greencard Approved!
03/12/15 - Greencard Received!
ROC Process:
02/07/2017 - NOA1
03/09/2017 - Biometrics
02/15/2018 - Extension Stamp in Passport at Local Office
