new born while f2a processing at NVC and USC pending

HI all

I am from India. My I-130 got approved (spouse) and transfer to NVC. I have 2 months old boy back at home. I submit his birth certificate at NVC.

1) My status as LPR he can come with my wife as dependent.

2) in next few months I am going to be a USC. May be by Feb-March 2014.

Question : should I have to wait for the processing at NVC, how long it will take to process a case at NVC under (LPR).

or upgrade it after I will be a USC. In that situation I have to file a new I-130 for my son and it's all new process.

Any suggestions will be appreciated.

Hi dens thanks for your reply. I know once I became a usc then need separate i130 for my son. But my case right now at nvc and my citizenship will be done means oth ceremony may be feb or march may be by that time I am done with nvc. Should I have to let the things go n wait.

Let see if you naturalize and your child case at still on NVC would be better call them before process will complete

I guess it will move faster than old petition

so that each case will not be wait for long

if you dont take a call for that situation they will keep your case on going in fact they wont know if your status was change or not.

Hi dens

Now my case is complete at NVC on 27th jan 2014

Waiting for interview letter.

Still I don't received my oath date for citizenship may be in a few days for march. And by that time may be I have interview letter too.

So what to do let it go like that.

Once NVC complete the case or transfer the case to counslar office and I got oath still I have to let them know about my citizenship or let it go.

Well I try to find out the answer every where different threads. Lack of information about this topic. Just heard postpone the oath ceremony , but no one tell what reason should I have to give USCIS.

I am going to write down my experience . May be it will help some one in near future.

F2A CC Jan,27,2014. Waiting for interview letter.

F2A interview schedule for April,08,2014.

USC oath letter received for FEB,28,2014.

Write down a request to local office to postpone oath ceremony . " REASON : IF I TOOK OATH THEN MY NEW BORN WILL GOING TO LOSE STATUS UNDER DERIVATIVE VISA."

March,23,2014 again received oath ceremony letter for April,04,2014.

write down another request with the same reason. this time USCIS sent me a letter . Saying that the above date April,04,2014 oath ceremony is cancelled due to "UNFORESEEN CIRCUMSTANCES" .

Today April,08,2014 wife visa approved. Ready for oath now.
